1 1 Section 1. Section 50.19, unnumbered paragraph 2, Code
1 2 1999, is amended to read as follows:
1 3 Material pertaining to elections for federal offices,
1 4 including voted ballots, precinct election registers,
1 5 declarations of eligibility signed by voters, documents
1 6 relating to absentee ballots, and challenges of voters, shall
1 7 be preserved for twenty-two months after the election. If a
1 8 contest is not pending the materials may be destroyed at the
1 9 end of the retention period.
1 10 Sec. 2. Section 50.19, Code 1999, is amended by adding the
1 11 following new unnumbered paragraph:
1 12 NEW UNNUMBERED PARAGRAPH. Unvoted ballots for all
1 13 elections may be destroyed ten days following the deadline to
1 14 contest the election for which the ballots were prepared or
1 15 the day after final determination of all pending contests of
1 16 the election for which the ballots were prepared, whichever is
1 17 later.
1 18 EXPLANATION
1 19 This bill allows county commissioners of elections to
1 20 destroy unvoted ballots 10 days after the deadline for
1 21 contesting the election for which the ballots were prepared or
1 22 the day after final determinations have been made in contests
1 23 of the election, whichever is later.
