Senate Study Bill 1149

  1  1    Section 1.  Section 252A.3A, subsection 5, Code 1999, is
  1  2 amended to read as follows:
  1  3    5.  A completed affidavit of paternity shall contain or
  1  4 have attached all of the following:
  1  5    a.  A statement by the mother consenting to the assertion
  1  6 of paternity and the identity of the father and acknowledging
  1  7 either any one of the following:
  1  8    (1)  That the mother was unmarried at the time of
  1  9 conception, birth, and at any time during the period between
  1 10 conception and birth of the child.
  1 11    (2)  That the mother was married at the time of conception,
  1 12 birth, or at any time during the period between conception and
  1 13 birth of the child, and that a court order has been entered
  1 14 ruling that the individual to whom the mother was married at
  1 15 that time is not the father of the child.
  1 16    (3)  That the mother was married at the time of conception
  1 17 or birth of the child, that the man to whom the mother was
  1 18 married at the time of conception or birth is not the
  1 19 biological father of the child, and that the mother, the man
  1 20 to whom she was married at the time of conception or birth,
  1 21 and the biological father of the child collectively stipulate
  1 22 that the man to whom the mother was married at the time of
  1 23 conception or birth is not the biological father of the child.
  1 24    b.  If paragraph "a", subparagraph (2), is applicable, a
  1 25 certified copy of the filed order ruling that the husband is
  1 26 not the father of the child.
  1 27    c.  A statement from the putative father that the putative
  1 28 father is the father of the child.
  1 29    d.  The name of the child at birth and the child's birth
  1 30 date.
  1 31    e.  The signatures of the mother and putative father.
  1 32    f.  The social security numbers of the mother and putative
  1 33 father.
  1 34    g.  The addresses of the mother and putative father, as
  1 35 available.
  2  1    h.  The signature of a notary public attesting to the
  2  2 identities of the parties signing the affidavit of paternity.
  2  3    i.  Instructions for filing the affidavit.
  2  4    j.  If paragraph "a", subparagraph (3), is applicable, a
  2  5 statement from the man who was married to the mother at the
  2  6 time of conception or birth of the child that the man is not
  2  7 the biological father of the child, a statement from the
  2  8 mother that the putative father is the biological father of
  2  9 the child, and a statement from the putative father that the
  2 10 putative father is the biological father of the child.
  2 11    k.  The child's name following completion of the paternity
  2 12 affidavit.  
  2 13                           EXPLANATION
  2 14    This bill establishes a three-way paternity affidavit for
  2 15 the situation when a woman's husband is not the biological
  2 16 father of a child conceived or born during the marriage and
  2 17 all three parties are in agreement.
