PAG LIN 1 1 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 2 1. There is appropriated from the fund created by section 1 3 8.41 to the Iowa department of public health for the federal 1 4 fiscal year beginning October 1, 1999, and ending September 1 5 30, 2000, the following amount: 1 6 ................................................ $ 11,945,086 1 7 a. Funds appropriated in this subsection are the 1 8 anticipated funds to be received from the federal government 1 9 for the designated federal fiscal year under 42 U.S.C., 1 10 chapter 6A, subchapter XVII, which provides for the substance 1 11 abuse prevention and treatment block grant. The department 1 12 shall expend the funds appropriated in this subsection as 1 13 provided in the federal law making the funds available and in 1 14 conformance with chapter 17A. 1 15 b. Of the funds appropriated in this subsection, an amount 1 16 not exceeding 5 percent shall be used by the department for 1 17 administrative expenses. 1 18 c. The department shall expend no less than an amount 1 19 equal to the amount expended for treatment services in state 1 20 fiscal year beginning July 1, 1998, for pregnant women and 1 21 women with dependent children. 1 22 d. Of the funds appropriated in this subsection, an amount 1 23 not exceeding $ 24,585 shall be used for audits. 1 24 2. The funds remaining from the appropriation made in 1 25 subsection 1 shall be allocated as follows: 1 26 a. At least 20 percent of the allocation shall be for 1 27 prevention programs. 1 28 b. At least 35 percent of the allocation shall be spent on 1 29 drug treatment and prevention activities. 1 30 c. At least 35 percent of the allocation shall be spent on 1 31 alcohol treatment and prevention activities. 1 32 3. The substance abuse block grant funds received from the 1 33 federal government in excess of the amount of the anticipated 1 34 federal fiscal year 1999-2000 award appropriated in subsection 1 35 1 shall be distributed at least 50 percent to treatment 2 1 programs and 50 percent to prevention programs except that, 2 2 based upon federal guidelines, the total amount of the excess 2 3 awarded to prevention programs shall not exceed $ 1,000,000. 2 4 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 2 5 1. a. There is appropriated from the fund created by 2 6 section 8.41 to the Iowa department of human services for the 2 7 federal fiscal year beginning October 1, 1999, and ending 2 8 September 30, 2000, the following amount: 2 9 ................................................ $ 2,740,750 2 10 b. Funds appropriated in this subsection are the 2 11 anticipated funds to be received from the federal government 2 12 for the designated federal fiscal year under 42 U.S.C., 2 13 chapter 6A, subchapter XVII, which provides for the community 2 14 mental health services block grant. The department shall 2 15 expend the funds appropriated in this subsection as provided 2 16 in the federal law making the funds available and in 2 17 conformance with chapter 17A. 2 18 c. The administrator of the division of mental health and 2 19 developmental disabilities of the department of human services 2 20 shall allocate not less than 95 percent of the amount of the 2 21 block grant to eligible community mental health services 2 22 providers for carrying out the plan submitted to and approved 2 23 by the federal substance abuse and mental health services 2 24 administration for the fiscal year involved. 2 25 2. An amount not exceeding 5 percent of the funds 2 26 appropriated in subsection 1 shall be used by the department 2 27 of human services for administrative expenses. From the funds 2 28 set aside by this subsection for administrative expenses, the 2 29 division of mental health and developmental disabilities shall 2 30 pay to the auditor of state an amount sufficient to pay the 2 31 cost of auditing the use and administration of the state's 2 32 portion of the funds appropriated in subsection 1. The 2 33 auditor of state shall bill the division of mental health and 2 34 developmental disabilities for the costs of the audits. 2 35 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 3 1 1. There is appropriated from the fund created by section 3 2 8.41 to the Iowa department of public health for the federal 3 3 fiscal year beginning October 1, 1999, and ending September 3 4 30, 2000, the following amount: 3 5 ................................................ $ 6,969,580 3 6 The funds appropriated in this subsection are the funds 3 7 anticipated to be received from the federal government for the 3 8 designated federal fiscal year under 42 U.S.C., chapter 7, 3 9 subchapter V, which provides for the maternal and child health 3 10 services block grant. The department shall expend the funds 3 11 appropriated in this subsection as provided in the federal law 3 12 making the funds available and in conformance with chapter 3 13 17A. 3 14 Of the funds appropriated in this subsection, an amount not 3 15 exceeding $ 45,700 shall be used for audits. 3 16 Funds appropriated in this subsection shall not be used by 3 17 the university of Iowa hospitals and clinics for indirect 3 18 costs. 3 19 2. An amount not exceeding $ 150,000 of the funds 3 20 appropriated in subsection 1 to the Iowa department of public 3 21 health shall be used by the Iowa department of public health 3 22 for administrative expenses in addition to the amount to be 3 23 used for audits in subsection 1. 3 24 The departments of public health, human services, and 3 25 education and the university of Iowa's mobile and regional 3 26 child health specialty clinics shall continue to pursue to the 3 27 maximum extent feasible the coordination and integration of 3 28 services to women and children. 3 29 3. a. Sixty-three percent of the remaining funds 3 30 appropriated in subsection 1 shall be allocated to supplement 3 31 appropriations for maternal and child health programs within 3 32 the Iowa department of public health. Of these funds, $ 3 33 284,548 shall be set aside for the statewide perinatal care 3 34 program. 3 35 b. Thirty-seven percent of the remaining funds 4 1 appropriated in subsection 1 shall be allocated to the 4 2 university of Iowa hospitals and clinics under the control of 4 3 the state board of regents for mobile and regional child 4 4 health specialty clinics. The university of Iowa hospitals 4 5 and clinics shall not receive an allocation for indirect costs 4 6 from the funds for this program. Priority shall be given to 4 7 establishment and maintenance of a statewide system of mobile 4 8 and regional child health specialty clinics. 4 9 4. The Iowa department of public health shall administer 4 10 the statewide maternal and child health program and the 4 11 crippled children's program by conducting mobile and regional 4 12 child health specialty clinics and conducting other activities 4 13 to improve the health of low-income women and children and to 4 14 promote the welfare of children with actual or potential 4 15 handicapping conditions and chronic illnesses in accordance 4 16 with the requirements of Title V of the federal Social 4 17 Security Act. 4 18 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 4 19 APPROPRIATIONS. 4 20 1. There is appropriated from the fund created by section 4 21 8.41 to the Iowa department of public health for the federal 4 22 fiscal year beginning October 1, 1999, and ending September 4 23 30, 2000, the following amount: 4 24 ................................................ $ 2,128,352 4 25 Funds appropriated in this subsection are the funds 4 26 anticipated to be received from the federal government for the 4 27 designated federal fiscal year under 42 U.S.C., chapter 6A, 4 28 subchapter XVII, which provides for the preventive health and 4 29 health services block grant. The department shall expend the 4 30 funds appropriated in this subsection as provided in the 4 31 federal law making the funds available and in conformance with 4 32 chapter 17A. 4 33 Of the funds appropriated in this subsection, an amount not 4 34 exceeding $ 5,522 shall be used for audits. 4 35 2. Of the funds appropriated in subsection 1, the specific 5 1 amount of funds stipulated by the notice of block grant award 5 2 shall be allocated for services to victims of sex offenses and 5 3 for rape prevention education. 5 4 3. An amount not exceeding $ 94,670 of the remaining 5 5 funds appropriated in subsections 1 and 2 shall be used by the 5 6 Iowa department of public health for administrative expenses 5 7 in addition to the amount to be used for audits in subsection 5 8 1. 5 9 4. After deducting the funds allocated in subsections 1, 5 10 2, and 3, the remaining funds appropriated in subsection 1 5 11 shall be used by the department for healthy people 2000 and 5 12 2010/healthy Iowans 2000 and 2010 program objectives, 5 13 preventive health advisory committee, and risk reduction 5 14 services, including nutrition programs, health incentive 5 15 programs, chronic disease services, emergency medical 5 16 services, monitoring of the fluoridation program and start-up 5 17 fluoridation grants, and acquired immune deficiency syndrome 5 18 services. The moneys specified in this subsection shall not 5 19 be used by the university of Iowa hospitals and clinics or by 5 20 the state hygienic laboratory for the funding of indirect 5 21 costs. Of the funds used by the department under this 5 22 subsection, an amount not exceeding $ 90,000 shall be used 5 23 for the monitoring of the fluoridation program and for start- 5 24 up fluoridation grants to public water systems, and at least $ 5 25 50,000 shall be used to provide chlamydia testing. 5 26 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM 5 27 APPROPRIATION. 5 28 1. There is appropriated from the fund created in section 5 29 8.41 to the office of the governor for the drug enforcement 5 30 and abuse prevention coordinator for the federal fiscal year 5 31 beginning October 1, 1999, and ending September 30, 2000, the 5 32 following amount: 5 33 ................................................ $ 5,865,000 5 34 Funds appropriated in this subsection are the anticipated 5 35 funds to be received from the federal government for the 6 1 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 2 V, which provides for the drug control and system improvement 6 3 grant program. The drug enforcement and abuse prevention 6 4 coordinator shall expend the funds appropriated in this 6 5 subsection as provided in the federal law making the funds 6 6 available and in conformance with chapter 17A. 6 7 2. An amount not exceeding 7 percent of the funds 6 8 appropriated in subsection 1 shall be used by the drug 6 9 enforcement and abuse prevention coordinator for 6 10 administrative expenses. From the funds set aside by this 6 11 subsection for administrative expenses, the drug enforcement 6 12 and abuse prevention coordinator shall pay to the auditor of 6 13 state an amount sufficient to pay the cost of auditing the use 6 14 and administration of the state's portion of the funds 6 15 appropriated in subsection 1. 6 16 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 6 17 APPROPRIATION. 6 18 1. There is appropriated from the fund created in section 6 19 8.41 to the office of the governor for the drug enforcement 6 20 and abuse prevention coordinator for the federal fiscal year 6 21 beginning October 1, 1999, and ending September 30, 2000, the 6 22 following amount: 6 23 ................................................ $ 1,647,000 6 24 Funds appropriated in this subsection are the anticipated 6 25 funds to be received from the federal government for the 6 26 designated fiscal year under 42 U.S.C., chapter 46, subchapter 6 27 XII-H, which provides for grants to combat violent crimes 6 28 against women. The drug enforcement and abuse prevention 6 29 coordinator shall expend the funds appropriated in this 6 30 subsection as provided in the federal law making the funds 6 31 available and in conformance with chapter 17A. 6 32 2. An amount not exceeding 5 percent of the funds 6 33 appropriated in subsection 1 shall be used by the drug 6 34 enforcement and abuse prevention coordinator for 6 35 administrative expenses. From the funds set aside by this 7 1 subsection for administrative expenses, the drug enforcement 7 2 and abuse prevention coordinator shall pay to the auditor of 7 3 the state an amount sufficient to pay the cost of auditing the 7 4 use and administration of the state's portion of the funds 7 5 appropriated in subsection 1. 7 6 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION. 7 7 1. There is appropriated from the fund created in section 7 8 8.41 to the office of the governor for the drug enforcement 7 9 and abuse prevention coordinator for the federal fiscal year 7 10 beginning October 1, 1999, and ending September 30, 2000, the 7 11 following amount: 7 12 ................................................ $ 322,049 7 13 Funds appropriated in this subsection are the funds 7 14 anticipated to be received from the federal government for the 7 15 designated federal fiscal year under annual federal 7 16 appropriations which provide for grants to reduce crime and 7 17 improve public safety. The drug enforcement and abuse 7 18 prevention coordinator shall expend the funds appropriated in 7 19 this subsection as provided in the federal law making the 7 20 funds available and in conformance with chapter 17A. 7 21 2. An amount not exceeding 3 percent of the funds 7 22 appropriated in subsection 1 shall be used by the drug 7 23 enforcement and abuse prevention coordinator for 7 24 administrative expenses. From the funds set aside by this 7 25 subsection for administrative expenses, the drug enforcement 7 26 and abuse prevention coordinator shall pay to the auditor of 7 27 state an amount sufficient to pay the cost of auditing the use 7 28 and administration of the state's portion of the funds 7 29 appropriated in subsection 1. 7 30 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 7 31 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 7 32 the fund created in section 8.41 to the office of the governor 7 33 for the drug enforcement and abuse prevention coordinator for 7 34 the federal fiscal year beginning October 1, 1999, and ending 7 35 September 30, 2000, the following amount: 8 1 ................................................ $ 514,497 8 2 Funds appropriated in this section are the funds 8 3 anticipated to be received from the federal government for the 8 4 designated federal fiscal year under 42 U.S.C., chapter 136, 8 5 which provides grants for substance abuse treatment programs 8 6 in state and local correctional facilities. The drug 8 7 enforcement and abuse prevention coordinator shall expend the 8 8 funds appropriated in this section as provided in the federal 8 9 law making the funds available and in conformance with chapter 8 10 17A. 8 11 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS. 8 12 1. a. There is appropriated from the fund created by 8 13 section 8.41 to the division of community action agencies of 8 14 the department of human rights for the federal fiscal year 8 15 beginning October 1, 1999, and ending September 30, 2000, the 8 16 following amount: 8 17 ................................................ $ 5,378,447 8 18 Funds appropriated in this subsection are the funds 8 19 anticipated to be received from the federal government for the 8 20 designated federal fiscal year under 42 U.S.C., chapter 106, 8 21 which provides for the community services block grant. The 8 22 division of community action agencies of the department of 8 23 human rights shall expend the funds appropriated in this 8 24 subsection as provided in the federal law making the funds 8 25 available and in conformance with chapter 17A. 8 26 b. The administrator of the division of community action 8 27 agencies of the department of human rights shall allocate not 8 28 less than 96 percent of the amount of the block grant to 8 29 eligible community action agencies for programs benefiting 8 30 low-income persons. Each eligible agency shall receive a 8 31 minimum allocation of not less than $ 100,000. The minimum 8 32 allocation shall be achieved by redistributing increased funds 8 33 from agencies experiencing a greater share of available funds. 8 34 The funds shall be distributed on the basis of the poverty- 8 35 level population in the area represented by the community 9 1 action areas compared to the size of the poverty-level 9 2 population in the state. 9 3 2. An amount not exceeding 4 percent of the funds 9 4 appropriated in subsection 1 shall be used by the division of 9 5 community action agencies of the department of human rights 9 6 for administrative expenses. From the funds set aside by this 9 7 subsection for administrative expenses, the division of 9 8 community action agencies of the department of human rights 9 9 shall pay to the auditor of state an amount sufficient to pay 9 10 the cost of auditing the use and administration of the state's 9 11 portion of the funds appropriated in subsection 1. The 9 12 auditor of state shall bill the division of community action 9 13 agencies for the costs of the audits. 9 14 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS. 9 15 1. There is appropriated from the fund created by section 9 16 8.41 to the department of economic development for the federal 9 17 fiscal year beginning October 1, 1999, and ending September 9 18 30, 2000, the following amount: 9 19 ................................................ $ 29,939,000 9 20 Funds appropriated in this subsection are the funds 9 21 anticipated to be received from the federal government for the 9 22 designated federal fiscal year under 42 U.S.C., chapter 69, 9 23 which provides for community development block grants. The 9 24 department of economic development shall expend the funds 9 25 appropriated in this subsection as provided in the federal law 9 26 making the funds available and in conformance with chapter 9 27 17A. 9 28 2. An amount not exceeding $ 1,397,560 for the federal 9 29 fiscal year beginning October 1, 1999, shall be used by the 9 30 department of economic development for administrative expenses 9 31 for the community development block grant. The total amount 9 32 used for administrative expenses includes $ 698,780 for the 9 33 federal fiscal year beginning October 1, 1999, of funds 9 34 appropriated in subsection 1 and a matching contribution from 9 35 the state equal to $ 698,780 from the appropriation of state 10 1 funds for the community development block grant and state 10 2 appropriations for related activities of the department of 10 3 economic development. From the funds set aside for 10 4 administrative expenses by this subsection, the department of 10 5 economic development shall pay to the auditor of state an 10 6 amount sufficient to pay the cost of auditing the use and 10 7 administration of the state's portion of the funds 10 8 appropriated in subsection 1. The auditor of state shall bill 10 9 the department for the costs of the audit. 10 10 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 10 11 1. There is appropriated from the fund created by section 10 12 8.41 to the division of community action agencies of the 10 13 department of human rights for the federal fiscal year 10 14 beginning October 1, 1999, and ending September 30, 2000, the 10 15 following amount: 10 16 ................................................ $ 19,951,229 10 17 The funds appropriated in this subsection are the funds 10 18 anticipated to be received from the federal government for the 10 19 designated federal fiscal year under 42 U.S.C., chapter 94, 10 20 subchapter II, which provides for the low-income home energy 10 21 assistance block grants. The division of community action 10 22 agencies of the department of human rights shall expend the 10 23 funds appropriated in this subsection as provided in the 10 24 federal law making the funds available and in conformance with 10 25 chapter 17A. 10 26 2. An amount not exceeding $ 1,995,122 or 10 percent of 10 27 the funds appropriated in subsection 1, whichever is less, may 10 28 be used for administrative expenses for the low-income home 10 29 energy assistance program. Not more than $ 290,000 shall be 10 30 used for administrative expenses of the division of community 10 31 action agencies of the department of human rights. From the 10 32 total funds set aside in this subsection for administrative 10 33 expenses for the low-income home energy assistance program, an 10 34 amount sufficient to pay the cost of an audit of the use and 10 35 administration of the state's portion of the funds 11 1 appropriated is allocated for that purpose. The auditor of 11 2 state shall bill the division of community action agencies for 11 3 the costs of the audits. 11 4 3. The remaining funds appropriated in subsection 1 shall 11 5 be allocated to help eligible households, as defined under 42 11 6 U.S.C., chapter 94, subchapter II, to meet the costs of home 11 7 energy. After reserving a reasonable portion of the remaining 11 8 funds not to exceed 10 percent of the funds appropriated in 11 9 subsection 1, to carry forward into the federal fiscal year 11 10 beginning October 1, 2000, at least 15 percent of the funds 11 11 appropriated in subsection 1 shall be used for low-income 11 12 residential weatherization or other related home repairs for 11 13 low-income households. Of this amount, an amount not 11 14 exceeding 10 percent may be used for administrative expenses. 11 15 4. An eligible household must be willing to allow 11 16 residential weatherization or other related home repairs in 11 17 order to receive home energy assistance. If the eligible 11 18 household resides in rental property, the unwillingness of the 11 19 landlord to allow residential weatherization or other related 11 20 home repairs shall not prevent the household from receiving 11 21 home energy assistance. 11 22 5. Not more than 5 percent of the funds appropriated in 11 23 subsection 1 shall be used for assessment and resolution of 11 24 energy problems. 11 25 Sec. 12. SOCIAL SERVICES APPROPRIATIONS. 11 26 1. There is appropriated from the fund created by section 11 27 8.41 to the department of human services for the federal 11 28 fiscal year beginning October 1, 1999, and ending September 11 29 30, 2000, the following amount: 11 30 ................................................ $ 20,408,465 11 31 Funds appropriated in this subsection are the funds 11 32 anticipated to be received from the federal government for the 11 33 designated federal fiscal year under 42 U.S.C., chapter 7, 11 34 subchapter XX, which provides for the social services block 11 35 grant. The department of human services shall expend the 12 1 funds appropriated in this subsection as provided in the 12 2 federal law making the funds available and in conformance with 12 3 chapter 17A. 12 4 2. Not more than $ 1,297,725 of the funds appropriated in 12 5 subsection 1 shall be used by the department of human services 12 6 for general administration. From the funds set aside in this 12 7 subsection for general administration, the department of human 12 8 services shall pay to the auditor of state an amount 12 9 sufficient to pay the cost of auditing the use and 12 10 administration of the state's portion of the funds 12 11 appropriated in subsection 1. 12 12 3. In addition to the allocation for general 12 13 administration in subsection 2, the remaining funds 12 14 appropriated in subsection 1 shall be allocated in the 12 15 following amounts to supplement appropriations for the federal 12 16 fiscal year beginning October 1, 1999, for the following 12 17 programs within the department of human services: 12 18 a. Field operations: 12 19 ................................................ $ 7,761,836 12 20 b. Child and family services: 12 21 ................................................ $ 1,160,954 12 22 c. Local administrative costs 12 23 and other local services: 12 24 ................................................ $ 823,166 12 25 d. Volunteers: 12 26 ................................................ $ 89,964 12 27 e. Community-based services: 12 28 ................................................ $ 103,458 12 29 f. MH/MR/DD/BI community service (local purchase): 12 30 ................................................ $ 9,171,362 12 31 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department 12 32 of human services during each state fiscal year shall develop 12 33 a plan for the use of federal social services block grant 12 34 funds for the subsequent state fiscal year. 12 35 The proposed plan shall include all programs and services 13 1 at the state level which the department proposes to fund with 13 2 federal social services block grant funds, and shall identify 13 3 state and other funds which the department proposes to use to 13 4 fund the state programs and services. 13 5 The proposed plan shall also include all local programs and 13 6 services which are eligible to be funded with federal social 13 7 services block grant funds, the total amount of federal social 13 8 services block grant funds available for the local programs 13 9 and services, and the manner of distribution of the federal 13 10 social services block grant funds to the counties. The 13 11 proposed plan shall identify state and local funds which will 13 12 be used to fund the local programs and services. 13 13 The proposed plan shall be submitted with the department's 13 14 budget requests to the governor and the general assembly. 13 15 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 13 16 HOMELESSNESS. Upon receipt of the minimum formula grant from 13 17 the federal alcohol, drug abuse, and mental health 13 18 administration to provide mental health services for the 13 19 homeless, the division of mental health and developmental 13 20 disabilities of the department of human services shall assure 13 21 that a project which receives funds under the formula grant 13 22 from either the federal or local match share of 25 percent in 13 23 order to provide outreach services to persons who are 13 24 chronically mentally ill and homeless or who are subject to a 13 25 significant probability of becoming homeless shall do all of 13 26 the following: 13 27 1. Provide community mental health services, diagnostic 13 28 services, crisis intervention services, and habilitation and 13 29 rehabilitation services. 13 30 2. Refer clients to medical facilities for necessary 13 31 hospital services, and to entities that provide primary health 13 32 services and substance abuse services. 13 33 3. Provide appropriate training to persons who provide 13 34 services to persons targeted by the grant. 13 35 4. Provide case management to homeless persons. 14 1 5. Provide supportive and supervisory services to certain 14 2 homeless persons living in residential settings which are not 14 3 otherwise supported. 14 4 6. Projects may expend funds for housing services 14 5 including minor renovation, expansion and repair of housing, 14 6 security deposits, planning of housing, technical assistance 14 7 in applying for housing, improving the coordination of housing 14 8 services, the costs associated with matching eligible homeless 14 9 individuals with appropriate housing, and one-time rental 14 10 payments to prevent eviction. 14 11 Sec. 15. CHILD CARE AND DEVELOPMENT FUND. There is 14 12 appropriated from the fund created by section 8.41 to the 14 13 department of human services for the federal fiscal year 14 14 beginning October 1, 1999, and ending September 30, 2000, the 14 15 following amount: 14 16 ................................................ $ 27,142,057 14 17 Funds appropriated in this section are the funds 14 18 anticipated to be received from the federal government under 14 19 42 U.S.C., chapter 105, subchapter II-B, which provides for 14 20 the child care and development fund. The department shall 14 21 expend the funds appropriated in this section as provided in 14 22 the federal law making the funds available and in conformance 14 23 with chapter 17A. 14 24 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 14 25 1. If the funds received from the federal government for 14 26 the block grants specified in this Act are less than the 14 27 amounts appropriated, the funds actually received shall be 14 28 prorated by the governor for the various programs, other than 14 29 for the services to victims of sex offenses and for rape 14 30 prevention education under section 4, subsection 2, of this 14 31 Act, for which each block grant is available according to the 14 32 percentages that each program is to receive as specified in 14 33 this Act. However, if the governor determines that the funds 14 34 allocated by the percentages will not be sufficient to effect 14 35 the purposes of a particular program, or if the appropriation 15 1 is not allocated by percentage, the governor may allocate the 15 2 funds in a manner which will effect to the greatest extent 15 3 possible the purposes of the various programs for which the 15 4 block grants are available. 15 5 2. Before the governor implements the actions provided for 15 6 in subsection 1, the following procedures shall be taken: 15 7 a. The chairpersons and ranking members of the senate and 15 8 house standing committees on appropriations, the appropriate 15 9 chairpersons and ranking members of subcommittees of those 15 10 committees, the director of the legislative service bureau, 15 11 and the director of the legislative fiscal bureau shall be 15 12 notified of the proposed action. 15 13 b. The notice shall include the proposed allocations, and 15 14 information on the reasons why particular percentages or 15 15 amounts of funds are allocated to the individual programs, the 15 16 departments and programs affected, and other information 15 17 deemed useful. Chairpersons notified shall be allowed at 15 18 least two weeks to review and comment on the proposed action 15 19 before the action is taken. 15 20 3. If the amount of moneys received from the federal 15 21 government for a specific grant number specified in this Act 15 22 is less than the amount appropriated, the amount appropriated 15 23 shall be reduced accordingly. An annual report listing any 15 24 such appropriation reduction shall be submitted to the fiscal 15 25 committee of the legislative council. 15 26 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 15 27 1. If funds received from the federal government in the 15 28 form of block grants exceed the amounts appropriated in 15 29 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess 15 30 shall be prorated to the appropriate programs according to the 15 31 percentages specified in those sections, except additional 15 32 funds shall not be prorated for administrative expenses. 15 33 2. If funds received from the federal government from 15 34 block grants exceed the amount appropriated in section 11 of 15 35 this Act for the low-income home energy assistance program, 15 16 1 percent of the excess shall be allocated to the low-income 16 2 residential weatherization program. 16 3 3. If funds received from the federal government from 16 4 community services block grants exceed the amount appropriated 16 5 in section 9 of this Act, 100 percent of the excess is 16 6 allocated to the community services block grant program. 16 7 4. If the amount of moneys received from the federal 16 8 government for a specific grant number specified in this Act 16 9 exceeds the amount appropriated, the excess amount is 16 10 appropriated for the purpose designated in the specific 16 11 grant's appropriation. An annual report listing any such 16 12 excess appropriations shall be submitted to the fiscal 16 13 committee of the legislative council. 16 14 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 16 15 FUNDS. If other federal grants, receipts, and funds and other 16 16 nonstate grants, receipts, and funds become available or are 16 17 awarded which are not available or awarded during the period 16 18 in which the general assembly is in session, but which require 16 19 expenditure by the applicable department or agency prior to 16 20 March 15 of the fiscal year beginning July 1, 1999, and ending 16 21 June 30, 2000, these grants, receipts, and funds are 16 22 appropriated to the extent necessary, provided that the fiscal 16 23 committee of the legislative council is notified within thirty 16 24 days of receipt of the grants, receipts, or funds and the 16 25 fiscal committee of the legislative council has an opportunity 16 26 to comment on the expenditure of the grants, receipts, or 16 27 funds. 16 28 Sec. 19. It 40 34 is the intent of the general assembly that if the governor 40 35 determines federal funds are insufficient to adequately 41 1 provide for certification of eligibility for the low-income 41 2 home energy assistance program by the community action 41 3 agencies during the federal fiscal year which commences 41 4 October 1, 1999, the Iowa utilities board shall issue an order 41 5 prohibiting disconnection of service from November 1 through 41 6 April 1 by a regulated public utility furnishing gas or 41 7 electricity to households whose income falls at or below one 41 8 hundred fifty percent of the federal poverty level as 41 9 established by the United States office of management and 41 10 budget. The board shall promptly adopt rules in accordance 41 11 with section 17A.4, subsection 2, and section 17A.5, 41 12 subsection 2, paragraph "b", to implement this requirement. 41 13 The energy assistance bureau of the department of human 41 14 rights, in consultation with the community action agencies, 41 15 shall certify to the utilities, households that are eligible 41 16 for moratorium protection utilizing the agency's existing 41 17 electronic database. Rules adopted under this section shall 41 18 also be published as a notice of intended action as provided 41 19 in section 17A.4. 41 20 EXPLANATION 41 21 The bill appropriates for the 1999-2000 federal fiscal year 41 22 which begins October 1, 1999, block grants available from the 41 23 federal government and provides procedures for increasing or 41 24 decreasing the appropriations if the block grants are 41 25 increased or decreased. General appropriations are made for 41 26 the 1999-2000 state fiscal year which begins July 1, 1999, of 41 27 all other nonstate grants, receipts, and funds available to 41 28 this state. Specific federal grants are also appropriated. 41 29 The bill includes legislative intent that Iowa utilities board 41 30 is to issue an order prohibiting disconnection of service to 41 31 certain low-income households if the governor determines 41 32 federal funds are insufficient to adequately provide for 41 33 certification of eligibility for the low-income home energy 41 34 assistance program (LIHEAP) by the community action agencies. 41 35 LSB 1137SC 78 42 1 jp/jw/5
