  1  1    Section 1.  Section 147.13, subsection 8, Code 1999, is
  1  2 amended to read as follows:
  1  3    8.  For dentistry, and dental hygiene, and dental
  1  4 assisting, dental examiners.
  1  5    Sec. 2.  Section 147.80, Code 1999, is amended by adding
  1  6 the following new subsection:
  1  7    NEW SUBSECTION.  27A.  Registration to practice as a dental
  1  8 assistant, registration to practice as a dental assistant
  1  9 under a reciprocal agreement, or renewal of registration to
  1 10 practice as a dental assistant.
  1 11    Sec. 3.  Section 153.14, subsection 1, Code 1999, is
  1 12 amended to read as follows:
  1 13    1.  Students of dentistry who practice dentistry upon
  1 14 patients at clinics in connection with their regular course of
  1 15 instruction at the state dental college and students of dental
  1 16 hygiene who practice upon patients at clinics in connection
  1 17 with their regular course of instruction at state-approved
  1 18 schools, and students of dental assisting who practice upon
  1 19 patients at clinics in connection with a regular course of
  1 20 instruction determined by the board of dentistry pursuant to
  1 21 section 153.39.
  1 22    Sec. 4.  Section 153.14, Code 1999, is amended by adding
  1 23 the following new subsection:
  1 24    NEW SUBSECTION.  5.  Persons registered to practice as a
  1 25 dental assistant.
  1 26    Sec. 5.  NEW SECTION.  153.38  DENTAL ASSISTANTS – SCOPE
  1 27 OF TERM.
  1 28    A registered dental assistant may perform those services of
  1 29 assistance to a licensed dentist as determined by the board of
  1 30 dentistry by rule.  Such services shall be performed under
  1 31 supervision of a licensed dentist in a dental office, a public
  1 32 or private school, public health agencies, hospitals, and the
  1 33 armed forces, but shall not be construed to authorize a dental
  1 34 assistant to practice dentistry or dental hygiene.  Every
  1 35 licensed dentist who utilizes the services of a registered
  2  1 dental assistant for the purpose of assistance in the practice
  2  2 of dentistry shall be responsible for acts delegated to the
  2  3 registered dental assistant.  A dentist shall delegate to a
  2  4 registered dental assistant only those acts which are
  2  5 authorized to be delegated to registered dental assistants by
  2  6 the board of dentistry.
  2  7    Sec. 6.  NEW SECTION.  153.39  DENTAL ASSISTANTS –
  2  8 REGISTRATION REQUIREMENTS, RENEWAL, REVOCATION, OR SUSPENSION.
  2  9    1.  A person shall not practice as a dental assistant
  2 10 unless the person has registered with the board and received a
  2 11 certificate of registration pursuant to this chapter.
  2 12    2.  The board shall mandate educational requirements and
  2 13 continuing education requirements by rule as a condition of
  2 14 registration or authority to perform the authorized duties of
  2 15 a registered dental assistant and shall establish a date by
  2 16 which individuals practicing as a dental assistant on the
  2 17 effective date of this Act shall be required to comply with
  2 18 registration requirements.  In order to renew registration as
  2 19 a registered dental assistant the board shall require a
  2 20 registrant to furnish evidence of satisfactory completion of
  2 21 continuing education requirements as established by rule.
  2 22    3.  The board shall establish standards for revocation or
  2 23 suspension of registration by rule.  
  2 24                           EXPLANATION 
  2 25    This bill provides that individuals practicing as dental
  2 26 assistants are required to register with the board of dental
  2 27 examiners.  The bill provides a scope of practice for
  2 28 registered dental assistants performing delegated functions
  2 29 under the supervision of a licensed dentist, and provides that
  2 30 the board of dental examiners is authorized to establish and
  2 31 regulate by rule dental assistant registration, renewal, and
  2 32 continuing education requirements, as well as standards
  2 33 relating to the revocation or suspension of registration.
