PAG LIN 1 1 Section 1. Section 903.1, subsection 1, paragraph a, Code 1 2 1999, is amended to read as follows: 1 3 a. For a simple misdemeanor,either imprisonment not to1 4exceed thirty days, orthere shall be a fine of at least fifty 1 5 dollars but not to exceedone hundredfive hundred dollars. 1 6 The court may order imprisonment not to exceed thirty days in 1 7 lieu of a fine or in addition to a fine. 1 8 EXPLANATION 1 9 This bill makes changes in the statute setting out the 1 10 general penalties for simple misdemeanors. The bill does not 1 11 modify current law which allows a specific penalty, rather 1 12 than the general penalty, to apply if the specific penalty is 1 13 set out in statute. The bill changes the general penalty for 1 14 simple misdemeanors to a fine of at least $50 but not more 1 15 than $500 and provides discretion to the court to sentence a 1 16 person to a jail sentence not to exceed 30 days in lieu of a 1 17 fine or in addition to a fine. The current general statutory 1 18 penalty for a simple misdemeanor is either a fine between $50 1 19 and $100 or a jail sentence not to exceed 30 days. 1 20 LSB 1238DP 78 1 21 jm/jw/5.1
