1 1 Section 1. Section 321G.13, subsection 8, Code 1999, is
1 2 amended to read as follows:
1 3 8. Upon an operating railroad right of way. An all-
1 4 terrain vehicle or snowmobile may be driven directly across a
1 5 railroad right of way only at an established crossing and,
1 6 notwithstanding any other provisions of law, may, if
1 7 necessary, use the improved portion of the established
1 8 crossing after yielding to all oncoming traffic. This
1 9 subsection does not apply to a law enforcement officer or
1 10 railroad employee in the lawful discharge of the officer's or
1 11 employee's duties or to an employee of a utility with
1 12 authority to enter upon the railroad right of way in the
1 13 lawful performance of the employee's duties.
1 14 EXPLANATION
1 15 This bill amends Code section 321G.13, relating to the
1 16 operation of all-terrain vehicles and snowmobiles, to provide
1 17 that an employee of a utility who is authorized to enter upon
1 18 a railroad right of way in the lawful performance of the
1 19 employee's duties is excepted from the prohibition on
1 20 operating all-terrain vehicles and snowmobiles on railroad
1 21 rights of way. Currently, only law enforcement officers and
1 22 railroad employees are excepted from the prohibition.
