PAG LIN 1 1 Section 1. NEW SECTION. 307.46 USE OF REVERSIONS. 1 2 1. Notwithstanding the provisions of section 8.33 or any 1 3 other provision of law to the contrary, if on June 30 of a 1 4 fiscal year a balance of an operational appropriation remains 1 5 unexpended or unencumbered, not more than fifty percent of the 1 6 balance may be encumbered by the department and used as 1 7 provided in this section and the remaining balance shall be 1 8 deposited in the fund from which the money was appropriated. 1 9 Moneys encumbered under this section shall be used by the 1 10 department during the succeeding fiscal year for employee 1 11 training and for technology enhancement. Moneys which are 1 12 encumbered under this section but not used shall revert to the 1 13 fund from which the money was appropriated on June 30 of the 1 14 succeeding fiscal year. 1 15 2. On or before June 30 of the fiscal year following the 1 16 fiscal year in which funds were encumbered under this section, 1 17 the department shall report to the joint transportation, 1 18 infrastructure, and capitals appropriations subcommittee, the 1 19 legislative fiscal bureau, the department of management, and 1 20 the legislative fiscal committee of the legislative council 1 21 detailing how the moneys were expended. Moneys shall not be 1 22 encumbered under this section from an appropriation which 1 23 received a transfer from another appropriation pursuant to 1 24 section 8.39. 1 25 3. For purposes of this section, "operational 1 26 appropriation" means an appropriation from the road use tax 1 27 fund or primary road fund providing for salaries, support, 1 28 maintenance, and miscellaneous purposes. 1 29 Sec. 2. Section 312.2, subsection 19, Code 1999, is 1 30 amended to read as follows: 1 31 19. The treasurer of state, before making the allotments 1 32 provided for in this section, shall credit annually from the 1 33 road use tax fund to the state department of transportation 1 34 the sum of six hundred fifty thousand dollars for the purpose 1 35 of providing county treasurers with data processing equipment 2 1 and support for vehicle registration and titling, and the sum 2 2 of three hundred eight thousand dollars for costs associated 2 3 with the county issuance of driver's licenses. 2 4 Notwithstanding section 8.33, unobligated funds credited under 2 5 this subsection remaining on June 30 of the fiscal year shall 2 6 not revert but shall remain available for expenditure for 2 7 purposes of this subsection in subsequent fiscal years. 2 8 Sec. 3. Sections 309.42 and 309.56, Code 1999, are 2 9 repealed. 2 10 Sec. 4. REVERSION OF GRANT FUNDING. Notwithstanding 2 11 section 8.33 and 1994 Iowa Acts, chapter 1199, section 8, the 2 12 funds transferred to the railway finance authority for a 2 13 community assistance grant in 1994 Iowa Act, chapter 1199, 2 14 section 8, subsection 7, shall not revert, but shall be 2 15 transferred to the railroad revolving loan fund established in 2 16 section 327H.20A. 2 17 Sec. 5. EFFECTIVE DATE. Section 1 of this Act, being 2 18 deemed of immediate importance, takes effect upon enactment. 2 19 EXPLANATION 2 20 This bill relates to the administration of the state 2 21 department of transportation. It authorizes the department to 2 22 encumber up to 50 percent of unused operational appropriations 2 23 to the department from the road use tax fund and the primary 2 24 road fund. The funds are to be used by the department during 2 25 the succeeding fiscal year for employee training and 2 26 technology enhancement. Any of the funds not used at the end 2 27 of that fiscal year for such training and technology will 2 28 revert to the fund from which the moneys was appropriated. 2 29 This bill establishes a standing limited appropriation from 2 30 the road use tax fund to support the county issuance of 2 31 driver's licenses and eliminates the requirement that the 2 32 department review plans and subsequent contracts for road, 2 33 bridge, and culvert construction on secondary roads. 2 34 This bill also specifies that money transferred from 2 35 lottery revenues to the railway finance authority for a 3 1 community assistance grant in 1994 Iowa Acts, chapter 1199, 3 2 shall not revert, but shall be transferred to the railroad 3 3 revolving loan fund. 3 4 LSB 1240DP 78 3 5 nh/gg/8
