PAG LIN 1 1 Section 1. NEW SECTION. 100.34 SPRINKLER SYSTEMS IN 1 2 SCHOOL BUILDING CONSTRUCTION. 1 3 1. All public and nonpublic school buildings, additions to 1 4 school buildings, and any alteration, remodeling, renovation, 1 5 or reconstruction projects affecting one or more areas of a 1 6 public or nonpublic school building that are cumulatively 1 7 equal to fifty percent or more of the square footage of the 1 8 school building, which are approved for construction after 1 9 August 15, 1999, shall require the installation of an 1 10 automatic sprinkler system designed and installed in 1 11 conformity with rules adopted by the state fire marshal 1 12 pursuant to this chapter. 1 13 2. The copy of the building plans submitted by the board 1 14 of directors of a school district to the building consultant 1 15 in the department of education for review pursuant to section 1 16 297.7 shall include the design and installation plans for the 1 17 automatic sprinkler system required under this section. 1 18 Sec. 2. Section 100.35, unnumbered paragraph 1, Code 1999, 1 19 is amended to read as follows: 1 20 The fire marshal shall adopt, and may amendrules under 1 21 chapter 17A, which include standards relating to exits and 1 22 exit lights, fire escapes, fire protection, fire safety and 1 23 the elimination of fire hazards, in and for churches, schools, 1 24 hotels, theaters, amphitheaters, hospitals, health care 1 25 facilities as defined in section 135C.1, boarding homes or 1 26 housing, rest homes, dormitories, college buildings, lodge 1 27 halls, club rooms, public meeting places, places of amusement, 1 28 apartment buildings, food establishments as defined in section 1 29 137F.1, and all other buildings or structures in which persons 1 30 congregate from time to time, whether publicly or privately 1 31 owned. In addition, the fire marshal shall adopt rules under 1 32 chapter 17A relating to the design and installation of 1 33 automatic sprinkler systems in school buildings in accordance 1 34 with section 100.34. Violation of a rule adopted by the fire 1 35 marshal is a simple misdemeanor. However, upon proof that the 2 1 fire marshal gave written notice to the defendant of the 2 2 violation, and proof that the violation constituted a clear 2 3 and present danger to life, and proof that the defendant 2 4 failed to eliminate the condition giving rise to the violation 2 5 within thirty days after receipt of notice from the fire 2 6 marshal, the penalty is that provided by law for a serious 2 7 misdemeanor. Each day of the continuing violation of a rule 2 8 after conviction of a violation of the rule is a separate 2 9 offense. A conviction is subject to appeal as in other 2 10 criminal cases. 2 11 Sec. 3. CONDITIONAL EFFECTIVE DATE. This Act shall not 2 12 take effect unless an appropriation is made which complies 2 13 with section 25B.2, subsection 3. 2 14 EXPLANATION 2 15 This bill provides that all public and nonpublic school 2 16 buildings, additions to school buildings, and any alteration, 2 17 remodeling, renovation, or reconstruction projects affecting 2 18 one or more areas of a public or nonpublic school building 2 19 that are cumulatively equal to 50 percent or more of the 2 20 square footage of the school building, which are approved for 2 21 construction after August 15, 1999, shall require the 2 22 installation of an automatic sprinkler system designed and 2 23 installed in conformity with rules to be adopted by the state 2 24 fire marshal. 2 25 The copy of the building plans submitted by the board of 2 26 directors of a school district to the building consultant in 2 27 the department of education for review pursuant to Code 2 28 section 297.7 shall include the design and installation plans 2 29 for the sprinkler system required. 2 30 This bill may create a state mandate under Code section 2 31 25A.2. The bill shall not take effect unless an appropriation 2 32 under Code section 25B.2, subsection 3, is made, fully funding 2 33 the cost of the bill or the state's proportionate share of the 2 34 cost. 2 35 LSB 1799SC 78 3 1 kh/gg/8
