  1  2                 BY  COMMITTEE ON ETHICS
  1  3 A Resolution relating to the senate rules governing
  1  4    lobbyists.
  1  5    BE IT RESOLVED BY THE SENATE, That the senate rules
  1  6 governing lobbyists for the seventy-seventh seventy-
  1  7 eighth general assembly shall be as follows:  
  1  8            SENATE RULES GOVERNING LOBBYISTS
  1  9    1.  DEFINITIONS.  As used in these rules, "client",
  1 10 "gift", "honoraria" or "honorarium", "lobbyist",
  1 11 "client", and "immediate family member" and "lobbyist"
  1 12 have the meaning provided in chapter 68B.  As used in
  1 13 these rules the term "political action committee"
  1 14 means a committee, but not a candidate's committee,
  1 15 which accepts contributions, makes expenditures, or
  1 16 incurs indebtedness in the aggregate of more than five
  1 17 hundred dollars in any one calendar year for the
  1 18 purpose of supporting or opposing a candidate for
  1 19 public office or ballot issue or influencing
  1 20 legislative action, or an association, lodge, society,
  1 21 cooperative, union, fraternity, sorority, educational
  1 22 institution, civic organization, labor organization,
  1 23 religious organization, or professional or other
  1 24 organization which makes contributions in the
  1 25 aggregate of more than five hundred dollars in any one
  1 26 calendar year for the purpose of supporting or
  1 27 opposing a candidate for public office or ballot issue
  1 28 or influencing legislative action.
  1 29    2.  APPLICABILITY.  These rules are only applicable
  1 30 to lobbying activities involving the Iowa general
  2  1 assembly.
  2  2    3.  REGISTRATION REQUIRED.  All lobbyists shall, on
  2  3 or before the day their lobbying activity begins,
  2  4 register with the secretary of the senate in the
  2  5 manner provided under section 68B.36 by filing a
  2  6 completed lobbyist's registration statement listing
  2  7 the items required under section 68B.36 form with the
  2  8 person or person designated by the chief clerk of the
  2  9 house and the secretary of the senate to receive
  2 10 lobbyist registration statements.  Lobbyist
  2 11 registration forms shall be available in the office of
  2 12 the chief clerk of the house and the secretary of the
  2 13 senate.  In addition, the lobbyist shall file with the
  2 14 secretary of the senate a statement of the general
  2 15 subjects of legislation in which the lobbyist is or
  2 16 may be interested, the numbers of the bills and
  2 17 resolutions and the bill number of study bills (if
  2 18 known) which will be lobbied, and whether the lobbyist
  2 19 intends to lobby for or against each bill, resolution,
  2 20 or study bill (if known), and on whose behalf the
  2 21 lobbyist is lobbying the bill, resolution, or study
  2 22 bill.
  2 23    Any change in or addition to the foregoing
  2 24 information shall be registered with the person or
  2 25 persons designated by the chief clerk of the house and
  2 26 the secretary of the senate within ten days after the
  2 27 change or addition is known to the lobbyist.
  2 28    Registration expires upon the commencement of the
  2 29 next regular session of the general assembly, except
  2 30 that the secretary of the senate may adopt and
  3  1 implement a reasonable pre-registration procedure in
  3  2 advance of each regular session during which persons
  3  3 may register for that session and the following
  3  4 legislative interim.
  3  5    4.  CANCELLATION OF REGISTRATION.  If a lobbyist's
  3  6 service on behalf of a particular employer, client, or
  3  7 cause is concluded prior to the end of the calendar
  3  8 year, the lobbyist may cancel the registration on
  3  9 appropriate forms supplied by the secretary of the
  3 10 senate.  Upon cancellation of registration, a lobbyist
  3 11 is prohibited from engaging in any lobbying activity
  3 12 on behalf of that particular employer, client, or
  3 13 cause until reregistering and complying with these
  3 14 rules.  A lobbyist's registration is valid for only
  3 15 one session of a general assembly.
  3 16    5.  AMENDMENT OF REGISTRATION.  If a registered
  3 17 lobbyist represents more than one employer, client, or
  3 18 cause and the lobbyist's services are concluded on
  3 19 behalf of a particular employer, client, or cause
  3 20 after the lobbyist registers but before the first day
  3 21 of the next legislative session, the lobbyist shall
  3 22 file an amendment to the lobbyist's registration
  3 23 indicating which employer, client, or cause is no
  3 24 longer represented by the lobbyist and the date upon
  3 25 which the representation concluded.
  3 26    If a lobbyist is retained by one or more additional
  3 27 employers, clients, or causes after the lobbyist
  3 28 registers but before the first day of the next
  3 29 legislative session, the lobbyist shall file an
  3 30 amendment to the lobbyist's registration indicating
  4  1 the employer, client, or cause to be added and the
  4  2 date upon which the representation begins.
  4  3    Amendments to a lobbyist's registration regarding
  4  4 changes which occur during the time that the general
  4  5 assembly is in session shall be filed within one
  4  6 working day after the date upon which the change in
  4  7 the lobbyist's representation becomes effective.
  4  8    6.  PUBLIC ACCESS.  All information filed by a
  4  9 lobbyist or a client of a lobbyist under chapter 68B
  4 10 of the Code is a public record and open to public
  4 11 inspection at any reasonable time.
  4 12    5. 7.  LOBBYIST AND CLIENT REPORTING.  Each
  4 13 lobbyist registered with the senate and each
  4 14 lobbyist's client shall file the reports required
  4 15 under sections 68B.37 and 68B.38 with the person
  4 16 designated by the chief clerk of the house and the
  4 17 secretary of the senate to receive lobbyist and client
  4 18 reports.
  4 19    For purposes of this rule, and the reports required
  4 20 under sections 68B.37 and 68B.38, "services enumerated
  4 21 under section 68B.2, subsection 13, paragraph "a"" and
  4 22 "lobbying purposes" include, but are not limited to,
  4 23 the following:
  4 24    a.  Time spent by the lobbyist at the state capitol
  4 25 building commencing with the first day of a
  4 26 legislative session and ending with the day of final
  4 27 adjournment of each legislative session as indicated
  4 28 by the journals of the house and senate.
  4 29    b.  Time spent by the lobbyist attending meetings
  4 30 or hearings which results in the lobbyist
  5  1 communicating with members of the general assembly or
  5  2 legislative employees about current or proposed
  5  3 legislation.
  5  4    c.  Time spent by the lobbyist researching and
  5  5 drafting proposed legislation with the intent to
  5  6 submit the legislation to a member of the general
  5  7 assembly or a legislative employee.
  5  8    d.  Time spent by the lobbyist actually
  5  9 communicating with members of the general assembly and
  5 10 legislative employees about current or proposed
  5 11 legislation.
  5 12    6. 8.  GOVERNMENT OFFICIALS.  All federal, state,
  5 13 and local officials or employees representing their
  5 14 departments, commissions, boards, or agencies shall
  5 15 present to the person designated by the chief clerk of
  5 16 the house and the secretary of the senate to receive
  5 17 registration statements a letter of authorization from
  5 18 their department or agency heads prior to the
  5 19 commencement of their lobbying.  The lobbyist
  5 20 registration statement of these officials and
  5 21 employees shall not be deemed complete until the
  5 22 letter of authorization is attached.  Federal, state,
  5 23 and local officials who wish to lobby in opposition to
  5 24 their departments, commissions, boards, or agencies
  5 25 must indicate such on their lobbyist registration
  5 26 statements.
  5 27    7. 9.  CHARGE ACCOUNTS AND LOANS.  Lobbyists and
  5 28 the organizations they represent shall not allow any
  5 29 senators to charge any amounts or items to any charge
  5 30 account to be paid for by those lobbyists or by the
  6  1 organizations they represent.  A lobbyist shall not
  6  2 make a loan to a senator unless the loan is made in
  6  3 the ordinary course of business, the lobbyist is in
  6  4 the business of making loans, and the terms and
  6  5 conditions of the loan are the same or substantially
  6  6 similar to the finance charges and loan terms that are
  6  7 available to members of the general public.
  6  8    8. 10.  OFFERS OF ECONOMIC OPPORTUNITY.  A
  6  9 lobbyist, an employer of a lobbyist, or a political
  6 10 action committee shall not offer economic or
  6 11 investment opportunity or promise of employment to any
  6 12 senator with intent to influence the senator's conduct
  6 13 in the performance of official duties.
  6 14    A lobbyist shall not take action intended to
  6 15 negatively affect the economic interests of a senator.
  6 16    For purposes of this rule, supporting or opposing a
  6 17 candidate for office or supporting or opposing a bill,
  6 18 amendment, or resolution shall not be considered to be
  6 19 action intended to negatively affect the economic
  6 20 interests of a senator.
  6 21    9. 11.  MEMBERSHIP CONTRIBUTIONS.  A lobbyist, or
  6 22 employer of a lobbyist, shall not pay for membership
  6 23 in or contributions to clubs or organizations on
  6 24 behalf of a senator.
  6 25    10. 12.  ACCESS TO SENATE FLOOR.  Lobbyists shall
  6 26 not be permitted on the floor of the senate while the
  6 27 senate is in session.  Elected state officials, except
  6 28 the governor, lieutenant governor, and the members of
  6 29 the house of representatives, shall not be permitted
  6 30 on the floor of the senate while the senate is in
  7  1 session to encourage the passage, defeat, or
  7  2 modification of legislation.
  7  3    11. 13.  EFFECTIVE PERIOD.  These rules governing
  7  4 lobbyists shall be in effect throughout the calendar
  7  5 year, whether or not the general assembly is in
  7  6 session.
  7  7    12. 14.  GIFTS.  A lobbyist or the client of a
  7  8 lobbyist shall not, directly or indirectly, offer or
  7  9 make a gift or a series of gifts to a senator, except
  7 10 as otherwise provided in section 68B.22.
  7 11    13. 15.  HONORARIA.  A lobbyist or client of a
  7 12 lobbyist shall not give an honorarium to a member or
  7 13 employee of the senate, except as otherwise provided
  7 14 in section 68B.23.
  7 15    14. 16.  COMPLAINTS.  Rules 15 through 23 of the
  7 16 senate code of ethics apply to complaints and
  7 17 procedures regarding violations of these rules.
