  1  1    Section 1.  Section 403.5, subsection 5, Code Supplement
  1  2 1999, is amended by adding the following new unnumbered
  1  3 paragraph:
  1  4    NEW UNNUMBERED PARAGRAPH.  If an urban renewal plan is
  1  5 amended and the amendment to the plan provides for the
  1  6 addition of territory to the urban renewal area, the
  1  7 assessment year established for the territory for purposes of
  1  8 dividing revenue under section 403.19 shall be that determined
  1  9 pursuant to section 403.19, subsection 7.
  1 10    Sec. 2.  Section 403.5, Code Supplement 1999, is amended by
  1 11 adding the following new subsection:
  1 12    NEW SUBSECTION.  8.  The urban renewal area covered by the
  1 13 plan shall be composed of contiguous territory as compact as
  1 14 practicable.  Parcels included in an urban renewal area may
  1 15 share a boundary with a waterway or with the right-of-way of a
  1 16 primary highway, secondary road, or street, but such waterway,
  1 17 highway, road, or street shall not be included solely as a
  1 18 means of connecting two or more noncontiguous parcels.
  1 19    Sec. 3.  Section 403.19, Code 1999, is amended by adding
  1 20 the following new subsection:
  1 21    NEW SUBSECTION.  7.  If an urban renewal plan is amended
  1 22 and the amendment to the plan provides for the addition of
  1 23 territory to the urban renewal area, the assessment year for
  1 24 the territory added to the urban renewal area, for purposes of
  1 25 dividing revenue under this section, shall be established as
  1 26 the assessment year beginning January 1 of the calendar year
  1 27 preceding the calendar year in which the municipality adopted
  1 28 the amendment to the plan.
  1 29    Sec. 4.  APPLICABILITY.  Section 2 of this Act applies to
  1 30 urban renewal areas established on or after the effective date
  1 31 of this Act.  Sections 1 and 3 of this Act apply to urban
  1 32 renewal plans establishing urban renewal areas, which plans
  1 33 were adopted before, on, or after the effective date of this
  1 34 Act.  
  1 35                           EXPLANATION
  2  1    This bill provides that if a municipality amends an urban
  2  2 renewal plan to add territory to an urban renewal area the
  2  3 base year for purposes of creating incremental valuation in
  2  4 the amended territory shall be the year prior to the year the
  2  5 amendment to the plan was adopted.  This portion of the bill
  2  6 applies to urban renewal plans adopted before, on, or after
  2  7 the effective date of the bill.
  2  8    The bill also requires that an urban renewal area be
  2  9 composed of contiguous territory and be compact in size.
  2 10 Parcels in an urban renewal area may border on a waterway or
  2 11 on the right-of-way of a highway, road, or street but the
  2 12 waterway, highway, road, or street cannot be used solely to
  2 13 connect two noncontiguous parcels.  This portion of the bill
  2 14 applies to urban renewal areas established on or after the
  2 15 effective date of the bill.
