1 4 RELATING TO PUBLIC AND WORKPLACE SAFETY AND WAGE COLLECTION
1 5 LAWS ADMINISTERED BY THE LABOR COMMISSIONER, INCLUDING
1 6 CHANGES IN THE REGULATION OF BOILERS IN PLACES OF PUBLIC
1 7 ASSEMBLY AND OF ELEVATOR INSTALLERS, AND OF EMPLOYERS UNDER
1 8 THE WAGE PAYMENT COLLECTION LAW.

1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 12 Section 1. Section 89.2, subsection 4, Code 1999, is
1 13 amended by striking the subsection and inserting in lieu
1 14 thereof the following:
1 15 4. "Public assembly" means the assembly of people in any
1 16 of the following:
1 17 a. A building or structure primarily used as a theater,
1 18 motion picture theater, museum, arena, exhibition hall,
1 19 school, college, dormitory, bowling alley, physical fitness
1 20 center, family entertainment center, lodge hall, union hall,
1 21 pool hall, casino, place of worship, funeral home, institution
1 22 of health and custodial care, hospital, or child care or adult
1 23 day care.
1 24 b. A building or structure, a portion of which is
1 25 primarily used for amusement, entertainment, or instruction.
1 26 c. A building or structure owned by or leased to the state
1 27 or any of its agencies or political subdivisions.
1 28 However, for purposes of this chapter, "public assembly"
1 29 does not include the assembly of people in buildings or
1 30 structures containing only eating and drinking establishments
1 31 or in any building used exclusively by an employer for
1 32 training or instruction of its own employees.
1 33 Sec. 2. Section 89A.1, Code Supplement 1999, is amended by
1 34 adding the following new subsection:
1 35 NEW SUBSECTION. 16A. "Owner" means the owner of a
2 1 facility, unless the facility is a new installation or is
2 2 undergoing major alterations, in which case the owner shall be
2 3 considered the person responsible for the installation or
2 4 alteration of the facility until the facility has passed final
2 5 inspection by the division.
2 6 Sec. 3. NEW SECTION. 91A.14 FORMER EMPLOYEES.
2 7 The rights and obligations outlined in this chapter
2 8 continue until they are fulfilled, even though the employer-
2 9 employee relationship has been severed.
