  1  1    Section 1.  Section 147.107, Code 1999, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  2A.  a.  A physician who dispenses
  1  4 prescription drugs shall comply with the dispensing
  1  5 requirements and patient care standards established by rule
  1  6 for pharmacists.
  1  7    b.  A physician who dispenses prescription drugs shall
  1  8 contract with a licensed pharmacist to provide oversight,
  1  9 advice, and counsel regarding the distribution, storage, and
  1 10 appropriate use of the prescription drugs prescribed.
  1 11    c.  A physician who dispenses prescription drugs shall
  1 12 provide the drugs at no more than cost, but may also charge a
  1 13 minimum fee, established by rule by the department, for
  1 14 overhead costs.
  1 15    d.  A physician who dispenses prescription drugs shall not
  1 16 enter into agreements with prescription drug distributors or
  1 17 with processors of information if the agreement provides
  1 18 incentives to the physician, including additional payments or
  1 19 drug rebates, for the sale of selected drug products.
  1 20    e.  The board of medical examiners and the board of
  1 21 pharmacy examiners shall jointly provide oversight and
  1 22 regulation of the physicians who dispense prescription drugs
  1 23 to ensure patient safety and care.
  1 24    f.  A physician who dispenses prescription drugs shall
  1 25 protect the confidentiality of patient specific information
  1 26 and shall not release such information, including information
  1 27 to be used by processors of information, without the patient's
  1 28 consent.  
  1 29                           EXPLANATION
  1 30    This bill provides certain requirements for physicians who
  1 31 dispense prescription drugs.  The requirements include that
  1 32 the physician shall comply with the rules for dispensing and
  1 33 patient care imposed on pharmacists; shall contract with a
  1 34 licensed pharmacist to provide oversight, advice, and counsel
  1 35 regarding the distribution, storage, and use of the drugs;
  2  1 shall sell drugs to a patient at no more than cost, with the
  2  2 exception that an additional fee, in an amount established by
  2  3 rule of the Iowa department of public health, may be charged
  2  4 for overhead costs; shall not enter into agreements with
  2  5 distributors of drugs or processors of information if the
  2  6 agreement includes incentives, including additional payments
  2  7 or rebates, for the sale of selected drugs; and shall protect
  2  8 the confidentiality of patient-specific information.  The bill
  2  9 also provides that the board of medical examiners and the
  2 10 board of pharmacy examiners are to jointly provide oversight
  2 11 and regulation of physician dispensing to ensure patient
  2 12 safety and patient care.
