  1  4 RELATING TO A STATE AGENCY PURCHASING PREFERENCE FOR BIO-BASED
  1  5    HYDRAULIC FLUIDS, GREASES, AND OTHER INDUSTRIAL LUBRICANTS.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 18.6, subsection 12, paragraph b, Code
  1 10 Supplement 1999, is amended to read as follows:
  1 11    b.  The procurement by state agencies of biodegradable bio-
  1 12 based hydraulic fluids, greases, and other industrial
  1 13 lubricants manufactured from soybeans in accordance with the
  1 14 requirements of section 18.22.
  1 15    Sec. 2.  Section 18.22, subsection 4, Code 1999, is amended
  1 16 to read as follows:
  1 17    4.  a.  Provide that when purchasing hydraulic fluids,
  1 18 greases, and other industrial lubricants the department or a
  1 19 state agency authorized by the department to directly purchase
  1 20 hydraulic fluids, greases, and other industrial lubricants
  1 21 shall give preference to purchasing biodegradable bio-based
  1 22 hydraulic fluids, greases, and other industrial lubricants
  1 23 manufactured from soybeans.
  1 24    b.  The department or state agency purchasing the hydraulic
  1 25 fluid shall purchase biodegradable hydraulic fluid, if both of
  1 26 the following apply:
  1 27    (1)  The purchase is within the purchasing budget of the
  1 28 department or a state agency.
  1 29    (2)  The use of biodegradable hydraulic fluid in the
  1 30 equipment operated by the department or state agency is
  1 31 consistent with the manufacturer's specifications for the
  1 32 equipment.
  1 33    c.  b.  The department shall provide for the implementation
  1 34 of requirements necessary in order to carry out this
  1 35 subsection by the department or state agency making the
  2  1 purchase, which shall include all of the following:
  2  2    (1)  Including the preference requirements in publications
  2  3 used to solicit bids for hydraulic fluids, greases, and other
  2  4 industrial lubricants.
  2  5    (2)  Describing the preference requirements at bidders'
  2  6 conferences in which bids for the sale of hydraulic fluids,
  2  7 greases, and other industrial lubricants are sought by the
  2  8 department or authorized state agency.
  2  9    (3)  Discussing the preference requirements in procurement
  2 10 solicitations or invitations to bid for hydraulic fluids,
  2 11 greases, and other industrial lubricants.
  2 12    (4)  Informing industry trade associations about the
  2 13 preference requirements.
  2 14    c.  As used in this section, unless the context otherwise
  2 15 requires:
  2 16    (1)  "Bio-based hydraulic fluids, greases, and other
  2 17 industrial lubricants" means as defined by the United States
  2 18 department of agriculture, if the department has adopted such
  2 19 a definition.  If the United States department of agriculture
  2 20 has not adopted a definition, "bio-based hydraulic fluids,
  2 21 greases, and other industrial lubricants" means hydraulic
  2 22 fluids, greases, and other lubricants containing a minimum of
  2 23 fifty-one percent soybean oil.
  2 24    (2)  "Other industrial lubricants" means lubricants used or
  2 25 applied to machinery.
  2 26    Sec. 3.  Section 216B.3, subsection 17, Code Supplement
  2 27 1999, is amended to read as follows:
  2 28    17.  Comply with the requirements for the purchase of
  2 29 lubricating oils, industrial oils, greases, and hydraulic
  2 30 fluids as established pursuant to section 18.22.
  2 31    Sec. 4.  Section 260C.19B, Code 1999, is amended to read as
  2 32 follows:
  2 33    260C.19B  PURCHASE OF BIODEGRADABLE BIO-BASED HYDRAULIC
  2 34 FLUIDS, GREASES, AND OTHER INDUSTRIAL LUBRICANTS.
  2 35    Hydraulic fluids, greases, and other industrial lubricants
  3  1 purchased by or used under the direction of the board of
  3  2 directors to provide services to a merged area shall be
  3  3 purchased in compliance with the preference requirements for
  3  4 purchasing biodegradable bio-based hydraulic fluids, greases,
  3  5 and other industrial lubricants as provided pursuant to
  3  6 section 18.22.
  3  7    Sec. 5.  Section 262.25B, Code 1999, is amended to read as
  3  8 follows:
  3  9    262.25B  PURCHASE OF BIODEGRADABLE BIO-BASED HYDRAULIC
  3 10 FLUIDS, GREASES, AND OTHER INDUSTRIAL LUBRICANTS.
  3 11    The state board of regents and institutions under the
  3 12 control of the board purchasing hydraulic fluids, greases, and
  3 13 other industrial lubricants shall give preference to
  3 14 purchasing biodegradable bio-based hydraulic fluids, greases,
  3 15 and other industrial lubricants as provided in section 18.22.
  3 16    Sec. 6.  Section 307.21, subsection 4, paragraph b,
  3 17 subparagraph (4), Code Supplement 1999, is amended to read as
  3 18 follows:
  3 19    (4)  Comply with the requirements for the purchase of
  3 20 lubricating oils, industrial oils, greases, and hydraulic
  3 21 fluids as established pursuant to section 18.22.
  3 22    Sec. 7.  Section 904.312B, Code 1999, is amended to read as
  3 23 follows:
  3 24    904.312B  PURCHASE OF BIODEGRADABLE BIO-BASED HYDRAULIC
  3 25 FLUIDS, GREASES, AND OTHER INDUSTRIAL LUBRICANTS.
  3 26    The department when purchasing hydraulic fluids, greases,
  3 27 and other industrial lubricants shall give preference to
  3 28 purchasing biodegradable bio-based hydraulic fluids, greases,
  3 29 and other industrial lubricants as provided in section 18.22.
