  1  4 RELATING TO THE USE OF SCHOOL IMPROVEMENT TECHNOLOGY PROGRAM 
  1  5    AND SCHOOL IMPROVEMENT TECHNOLOGY BLOCK GRANT PROGRAM MONEYS
  1  6    BY SCHOOL DISTRICTS AND AREA EDUCATION AGENCIES TO EMPLOY OR 
  1  7    CONTRACT WITH INFORMATION TECHNOLOGY SPECIALISTS.  
  1  8 
  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 256D.8, subsections 1 and 3, Code
  1 12 Supplement 1999, are amended to read as follows:
  1 13    1.  Except as provided in subsection 2, a school district
  1 14 shall expend funds received pursuant to section 256D.5,
  1 15 subsection 2, for the acquisition, lease, lease-purchase,
  1 16 installation, and maintenance of instructional technology
  1 17 equipment, including hardware and software, materials and
  1 18 supplies related to instructional technology, and staff
  1 19 development and training related to instructional technology,
  1 20 and shall establish priorities for the use of the funds.
  1 21 However, funds received by a school district pursuant to
  1 22 section 256D.5, subsection 2, shall not be expended to add a
  1 23 full-time equivalent position or otherwise increase staffing,
  1 24 unless the school district expends not more than ten percent
  1 25 of the funds received to employ or enter into a contract with
  1 26 information technology specialists to provide technical
  1 27 consulting and integration of technology in curriculum and
  1 28 instruction to advance student achievement.
  1 29    3.  Funds received by an area education agency pursuant to
  1 30 section 256D.6, subsection 2, shall be expended for the costs
  1 31 related to supporting school districts within the area served
  1 32 with technology planning and equipment, including hardware and
  1 33 software, materials and supplies related to instructional
  1 34 technology, employment of or contracting with information
  1 35 technology specialists to provide technical consulting and
  2  1 integration of technology in curriculum and instruction, and
  2  2 staff development and training related to instructional
  2  3 technology.
  2  4    Sec. 2.  Section 295.4, Code 1999, is amended to read as
  2  5 follows:
  2  6    295.4  SCHOOL IMPROVEMENT AND TECHNOLOGY EXPENDITURES.
  2  7    1.  School districts, as defined in section 295.2,
  2  8 subsection 8, shall expend funds received pursuant to section
  2  9 295.2 for the acquisition, lease, lease-purchase,
  2 10 installation, and maintenance of instructional technology
  2 11 equipment, including hardware and software, materials and
  2 12 supplies related to instructional technology, and staff
  2 13 development and training related to instructional technology,
  2 14 and shall establish priorities for the use of the funds.
  2 15 However, funds received by a school district pursuant to
  2 16 section 295.2 shall not be expended to add a full-time
