PAG LIN 1 1 Section 1. Section 384.96, Code 1999, is amended to read 1 2 as follows: 1 3 384.96 SEALED BIDS. 1 4 When the estimated total cost to a city of a public 1 5 improvement exceeds the sum oftwenty-fivefifty thousand 1 6 dollars, the governing body shall advertise for sealed bids 1 7 for the proposed improvement by publishing a notice to bidders 1 8 as provided in section 362.3, except that the notice to 1 9 bidders may be published more than twenty days but not more 1 10 than forty-five days before the date for filing bids. 1 11 Sec. 2. Section 384.102, Code 1999, is amended to read as 1 12 follows: 1 13 384.102 WHEN HEARING NECESSARY. 1 14 When the estimated total cost of a public improvement 1 15 exceeds the sum oftwenty-fivefifty thousand dollars, the 1 16 governing body shall not enter into a contract for the 1 17 improvement until it has held a public hearing on the proposed 1 18 plans, specifications, and form of contract, and estimated 1 19 cost for the improvement. Notice of the hearing must be 1 20 published as provided in section 362.3. At the hearing any 1 21 interested person may appear and file objections to the 1 22 proposed plans, specifications, contract, or estimated cost of 1 23 the improvement. After hearing objections, the governing body 1 24 shall by resolution enter its decision on the plans, 1 25 specifications, contract, and estimated cost. 1 26 EXPLANATION 1 27 This bill increases the estimated cost of a city public 1 28 improvement requiring public bidding procedures from $25,000 1 29 to $50,000. By reference, this bill also increases the 1 30 estimated cost of a rural water district improvement requiring 1 31 public bidding procedures to $50,000. 1 32 LSB 6462SS 78 1 33 tj/as/5.2
