1 1 Section 1. SALES TAX SURVEY. The Iowa state university of
1 2 science and technology in conjunction with the department of
1 3 revenue and finance shall conduct a survey to determine the
1 4 residency of persons paying sales tax in the state and the
1 5 location where the sales tax is paid. The purpose of the
1 6 survey is to develop a distribution formula for local sales
1 7 and services tax revenues collected for school infrastructure
1 8 purposes under chapter 422E, which formula would base the
1 9 distribution of such revenues back to the school district of
1 10 the retail purchaser paying the tax. The results of the
1 11 survey and the distribution formula shall be submitted to the
1 12 members of the general assembly by January 15, 2001, with
1 13 copies also sent to the legislative fiscal bureau legislative
1 14 service bureau. Notwithstanding any other provision, the
1 15 director of revenue and finance shall use the formula to
1 16 distribute local sales and use tax revenues beginning with the
1 17 fiscal year beginning July 1, 2001, subject to the
1 18 distribution formula's approval by the general assembly.
1 19 Iowa state university of science and technology may request
1 20 reimbursement from the legislative council for the cost of
1 21 conducting the survey and developing the distribution formula.
1 22 Any reimbursement authorized by the legislative council shall
1 23 be paid from funds available pursuant to section 2.12.
1 24 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 25 immediate importance, takes effect upon enactment.
1 26 EXPLANATION
1 27 This bill directs Iowa state university (ISU) in
1 28 conjunction with the department of revenue and finance to
1 29 conduct a survey for purposes of developing a formula that
1 30 will provide for the distribution of local sales and services
1 31 tax revenues collected for school infrastructure based upon
1 32 the residency of the purchaser paying the tax. ISU is to
1 33 submit its survey results and proposed distribution formula to
1 34 the general assembly by January 15, 2001. The distribution
1 35 formula shall be used beginning with the fiscal year 2001-
2 1 2002, subject to approval by the general assembly. ISU may
2 2 request reimbursement from the legislative council for its
2 3 costs in conducting the survey and developing the formula.
2 4 The bill takes effect upon enactment.
