  1  1    Section 1.  Section 282.18, subsection 10, Code 1999, is
  1  2 amended to read as follows:
  1  3    10.  Notwithstanding section 285.1 relating to
  1  4 transportation of nonresident pupils, the parent or guardian
  1  5 is responsible for transporting the pupil without
  1  6 reimbursement to and from a point on a regular school bus
  1  7 route of the receiving district.  However, a receiving
  1  8 district may send school vehicles into the district of
  1  9 residence of the pupil using the participating in open
  1 10 enrollment option under this section, for the purpose of
  1 11 transporting the pupil to and from school in the receiving
  1 12 district, if the boards of both the sending and receiving
  1 13 districts agree to this arrangement.  If the pupil meets the
  1 14 economic eligibility requirements established by the
  1 15 department and state board of education, the sending receiving
  1 16 district is responsible for providing transportation or paying
  1 17 the pro rata cost of the transportation to a parent or
  1 18 guardian for transporting the pupil to and from a point on a
  1 19 regular school bus route of a contiguous receiving sending
  1 20 district unless the cost of providing transportation or the
  1 21 pro rata cost of the transportation to a parent or guardian
  1 22 exceeds the average transportation cost per pupil transported
  1 23 for the previous school year in the district.  If the cost
  1 24 exceeds the average transportation cost per pupil transported
  1 25 for the previous school year, the sending receiving district
  1 26 shall only be responsible for that average per pupil amount.
  1 27 A sending district which provides transportation for a pupil
  1 28 to a contiguous receiving district under this subsection may
  1 29 withhold from the district cost per pupil amount, that is to
  1 30 be paid to the receiving district, an amount which represents
  1 31 the average or pro rata cost per pupil for transportation,
  1 32 whichever is less.  
  1 33                           EXPLANATION
  1 34    This bill permits a receiving district to send a school
  1 35 vehicle into the school district of residence in order to
  2  1 transport a child open enrolled in the receiving district.
  2  2 Currently, the Code requires that both the sending and
  2  3 receiving districts agree to the transportation arrangement.
  2  4    In situations where a pupil participating in open
  2  5 enrollment meets certain economic eligibility requirements,
  2  6 the bill switches, from the sending district to the receiving
  2  7 district, the responsibility for providing transportation or
  2  8 paying the pro rata cost of the transportation to a parent or
  2  9 guardian for transporting the pupil.  The bill strikes Code
  2 10 language that caps the financial responsibility to not more
  2 11 than the average transportation cost per pupil transported for
  2 12 the previous school year in the district.
  2 13    The bill also strikes Code language that permits a sending
  2 14 district to withhold the district cost per pupil amount that
  2 15 would otherwise be paid to the receiving district if the
  2 16 sending district transports a pupil to the receiving district.
