  1  1    Section 1.  NEW SECTION.  263.21  DEFINITIONS.
  1  2    As used in this section:
  1  3    1.  "Center" means the center for community development
  1  4 planning established pursuant to section 263.22.
  1  5    2.  "Community" means a county or city.
  1  6    3.  "Council" means the community development planning
  1  7 council established pursuant to section 261.23.
  1  8    4.  "Executive director" means the executive director of
  1  9 the center as provided in section 263.22.
  1 10    5.  "University" means the university of Iowa.
  1 11    Sec. 2.  NEW SECTION.  263.22  ESTABLISHMENT OF CENTER –
  1 12 PURPOSE – EXECUTIVE DIRECTOR.
  1 13    1.  The center for community development planning is
  1 14 established at the university.  The purpose of the center is
  1 15 to assist communities in planning for development.
  1 16    2.  The center shall be administered by an executive
  1 17 director appointed by the president of the university.  The
  1 18 director shall employ necessary staff.  The director and staff
  1 19 shall be employees of the university.
  1 20    Sec. 3.  NEW SECTION.  263.23  COMMUNITY DEVELOPMENT
  1 21 PLANNING COUNCIL.
  1 22    1.  A community development planning council is established
  1 23 which shall advise the executive director in carrying out the
  1 24 purpose of the center.
  1 25    2.  The council shall be composed of seven individuals,
  1 26 appointed by the president of the university, who shall be
  1 27 knowledgeable about community development issues, including
  1 28 persons with expertise in areas related to economic
  1 29 development, land use planning, transportation, soil
  1 30 conservation, and local government.
  1 31    3.  The terms of the members of the council shall begin and
  1 32 end as provided in section 69.19.  The terms shall be for four
  1 33 years and shall be staggered as determined by the president of
  1 34 the university.  Members who are not employed by the state or
  1 35 a political subdivision shall be reimbursed for actual and
  2  1 necessary expenses incurred while engaged in their official
  2  2 duties.  However, a member shall not be entitled to per diem
  2  3 compensation as authorized under section 7E.6.
  2  4    Sec. 4.  NEW SECTION.  263.24  COMMUNITY PLANNING
  2  5 ASSISTANCE.
  2  6    1.  The center shall assist communities in making planning
  2  7 decisions, including planning decisions relating to all of the
  2  8 following:
  2  9    a.  The classification of land based on use, including
  2 10 agricultural, commercial, industrial, residential,
  2 11 recreational, cultural, and historic uses.
  2 12    b.  The manner in which development occurs, including by
  2 13 incorporation, discontinuation, annexation, severance, and
  2 14 consolidation.  The center shall assist two or more
  2 15 communities in cooperating with one another to develop or
  2 16 preserve areas of common interest.
  2 17    c.  The provision of public benefits and services in areas
  2 18 being developed or in areas planned for development, including
  2 19 but not limited to the construction and maintenance of
  2 20 infrastructure, such as transportation systems and public
  2 21 utilities; the construction of public buildings, such as
  2 22 schools; and the delivery of services, such as fire protection
  2 23 and suppression, law enforcement, and the collection and
  2 24 disposal of refuse.
  2 25    d.  Fiscal impacts resulting from development.  The center
  2 26 shall provide economic models in order to evaluate development
  2 27 strategies.
  2 28    e.  The impact of development on the natural environment,
  2 29 business expansion, and housing.
  2 30    2.  The center shall provide technical and outreach support
  2 31 to communities, including but not limited to providing
  2 32 information and advice.  The center shall provide assistance
  2 33 to communities in adopting comprehensive plans, zoning
  2 34 regulations, and sustainable development policies.
  2 35    3.  The center shall cooperate with private organizations
  3  1 and governmental entities, including but not limited to other
  3  2 regents institutions; the state department of transportation;
  3  3 the department of natural resources; and regional development
  3  4 authorities, such as a council of governments established
  3  5 pursuant to chapter 28H or a joint planning commission
  3  6 established pursuant to chapter 28I.
  3  7    Sec. 5.  NEW SECTION.  263.25  COMMUNITY DEVELOPMENT
  3  8 PLANNING CENTER FUND.
  3  9    1.  A community development planning center fund is created
  3 10 in the state treasury under the control of the executive
  3 11 director.  The fund is composed of fees paid to the department
  3 12 of revenue and finance which have been collected by county
  3 13 auditors for deposit into the fund pursuant to section
  3 14 331.507.  The fund may include moneys appropriated by the
  3 15 general assembly and other moneys available to and obtained or
  3 16 accepted by the center.
  3 17    2.  Moneys in the fund are appropriated to carry out the
  3 18 functions of the center as provided in this chapter, including
  3 19 the payment of salaries and benefits to the executive director
  3 20 and other staff.  Moneys in the fund are subject to an annual
  3 21 audit by the auditor of state.  The fund is subject to
  3 22 warrants issued by the director of revenue and finance, drawn
  3 23 upon the written requisition of the executive director.
  3 24    3.  Section 8.33 does not apply to moneys in the fund.
  3 25 Notwithstanding section 12C.7, income or earnings derived from
  3 26 the investment of moneys in the fund shall be credited to the
  3 27 fund.
  3 28    Sec. 6.  Section 331.507, subsection 2, unnumbered
  3 29 paragraph 1, Code 1999, is amended to read as follows:
  3 30    The auditor is entitled to shall collect the following
  3 31 fees:
  3 32    Sec. 7.  Section 331.507, subsection 2, paragraph a,
  3 33 unnumbered paragraph 1, Code 1999, is amended to read as
  3 34 follows:
  3 35    For a transfer of property made in the transfer records,
  4  1 five eight dollars for each separate parcel of real estate
  4  2 described in a deed, or transfer of title certified by the
  4  3 clerk of the district court.  However, the fee shall not
  4  4 exceed fifty fifty-three dollars for a transfer of property
  4  5 which is described in one instrument of transfer.
  4  6    Sec. 8.  Section 331.507, subsection 3, Code 1999, is
  4  7 amended to read as follows:
  4  8    3.  Fees collected or received by the auditor under this
  4  9 section shall be accounted for and paid as follows:
  4 10    a.  The first five dollars collected under this section for
  4 11 each separate parcel of real estate, up to fifty dollars for
  4 12 transfers of property described in one instrument shall be
  4 13 paid into the county treasury as provided in section 331.902.
  4 14    b.  The remaining moneys collected under this section shall
  4 15 be paid to the department of revenue and finance on a monthly
  4 16 basis for deposit in the community development planning center
  4 17 fund created in section 263.25.  
  4 18                           EXPLANATION
  4 19    This bill establishes the center for community development
  4 20 planning as part of the university of Iowa.  According to the
  4 21 bill, the purpose of the center is to assist communities,
  4 22 including counties and cities, in planning for community
  4 23 development.  The bill provides for an executive director to
  4 24 administer the center and a council to advise the executive
  4 25 director.
  4 26    The bill provides that the center is required to assist
  4 27 communities in making planning decisions, including planning
  4 28 decisions relating to the classification of land based on use;
  4 29 the manner in which development occurs; the provision of
  4 30 public benefits and services; fiscal impacts; and the impact
  4 31 of development on the natural environment, business expansion,
  4 32 and housing.
  4 33    The bill requires the center to provide technical and
  4 34 outreach support to communities, including but not limited to
  4 35 providing information and advice.  The bill requires the
  5  1 center to cooperate with private organizations and
  5  2 governmental entities.
  5  3    The bill increases the fees required to be collected by
  5  4 county auditors for the transfer of real estate documents such
  5  5 as deeds from $5 to $8.  The additional fees are to be paid to
  5  6 the department of revenue and finance for deposit into a
  5  7 community development planning center fund established under
  5  8 the bill.  Moneys in the fund are appropriated to support the
  5  9 activities of the center.
