1 1 Section 1. NEW SECTION. 714.2A MOTOR VEHICLE FUEL THEFT.
1 2 The penalty for theft in violation of section 714.2,
1 3 subsection 5, involving the taking of motor vehicle fuel from
1 4 a retail dealer, as defined under section 214A.1, shall
1 5 include assessment of a fine of not less than two hundred
1 6 fifty dollars and imprisonment for not less than five days.
1 7 EXPLANATION
1 8 This bill establishes a minimum criminal penalty for simple
1 9 misdemeanor theft of motor vehicle fuel from a retail dealer.
1 10 The bill provides that a person who commits theft of motor
1 11 vehicle fuel from a retail dealer of motor vehicle fuel shall
1 12 be assessed a minimum fine of $250 and be imprisoned for at
1 13 least five days. Under existing law, a simple misdemeanor is
1 14 punishable by confinement for no more than 30 days or a fine
1 15 of at least $50 but not more than $500 or by both.
