  1  1    Section 1.  Section 257.11, Code 1999, is amended by
  1  2 striking the section and inserting in lieu thereof the
  1  3 following:
  1  4    257.11  SUPPLEMENTARY WEIGHTING.
  1  5    1.  REGULAR CURRICULUM.  Pupils in a regular curriculum
  1  6 attending all their classes in the district in which they
  1  7 reside, taught by teachers employed by that district, and
  1  8 having administrators employed by that district, are assigned
  1  9 a weighting of one.
  1 10    2.  DISTRICT-TO-DISTRICT SHARING.
  1 11    a.  In order to provide additional funds for school
  1 12 districts which send their resident pupils to another school
  1 13 district, which jointly employ and share the services of
  1 14 teachers under section 280.15, or which use the services of a
  1 15 teacher employed by another school district, a supplementary
  1 16 weighting plan for determining enrollment is adopted.
  1 17    b.  If the school budget review committee certifies to the
  1 18 department of management that the shared classes or teachers
  1 19 would otherwise not be implemented without the assignment of
  1 20 additional weighting, pupils attending classes in another
  1 21 school district, attending classes taught by a teacher who is
  1 22 employed jointly under section 280.15, or attending classes
  1 23 taught by a teacher who is employed by another school
  1 24 district, are assigned a weighting, in addition to the
  1 25 weighting assigned in subsection 1, of forty-eight hundredths
  1 26 of the percentage of the pupil's school day during which the
  1 27 pupil attends classes in another district, attends classes
  1 28 taught by a teacher who is jointly employed under section
  1 29 280.15, or attends classes taught by a teacher who is employed
  1 30 by another school district.
  1 31    3.  DISTRICT-TO-COMMUNITY-COLLEGE SHARING.
  1 32    a.  In order to provide additional funds for school
  1 33 districts which send their resident pupils to a community
  1 34 college for classes, a supplementary weighting plan for
  1 35 determining enrollment is adopted.
  2  1    b.  If the school budget review committee certifies to the
  2  2 department of management that the class would not otherwise be
  2  3 implemented without the assignment of additional weighting,
  2  4 pupils attending a community college-offered class or
  2  5 attending a class taught by a community college-employed
  2  6 teacher are assigned a weighting, in addition to the weighting
  2  7 assigned in subsection 1, of forty-eight hundredths of the
  2  8 percentage of the pupil's school day during which the pupil
  2  9 attends class in the community college or attends a class
  2 10 taught by a community college-employed teacher.  The following
  2 11 requirements shall be met for the purposes of assigning an
  2 12 additional weighting for classes offered through a sharing
  2 13 agreement between a school district and community college.
  2 14 The class must be:
  2 15    (1)  Supplementing high school classes and not supplanting
  2 16 a class that was offered in the preceding year or the second
  2 17 preceding year.
  2 18    (2)  Included in the community college catalog or other
  2 19 official college literature describing class offerings.
  2 20    (3)  Open to all registered community college students, not
  2 21 just high school students.
  2 22    (4)  For college credit and the credit must apply toward an
  2 23 associate of arts or associate of science degree, or toward an
  2 24 associate of applied arts or associate of applied science
  2 25 degree, or toward completion of a diploma program.
  2 26    (5)  Taught by a teacher meeting requirements for providing
  2 27 instruction at the community college level.
  2 28    (6)  Taught utilizing the class syllabus approved by the
  2 29 community college.
  2 30    (7)  Of the same quality as a class offered on a community
  2 31 college campus.
  2 32    4.  ALTERNATIVE HIGH SCHOOLS.
  2 33    a.  In order to provide additional funding to school
  2 34 districts for alternative high school programs, a
  2 35 supplementary weighting plan for alternative high school
  3  1 pupils is adopted.  A supplementary weighting of thirteen
  3  2 thousandths per pupil shall be assigned to the percentage of
  3  3 pupils in a school district enrolled in grades one through
  3  4 six, as reported by the school district on the basic
  3  5 educational data survey for the base year, who are eligible
  3  6 for free lunches under the federal National School Lunch Act
  3  7 and the federal Child Nutrition Act of 1966, 42 U.S.C. } 1751-
  3  8 1785, multiplied by the enrollment in grades eleven and twelve
  3  9 in the school district.  Amounts received as supplementary
  3 10 weighting for alternative high school pupils shall be utilized
  3 11 by a school district to develop or maintain alternative high
  3 12 school programs within the district, either through
  3 13 facilitation of a program provided by the school district,
  3 14 through a shared program with another school district, or
  3 15 through a shared program with a community college that would
  3 16 otherwise not receive funding pursuant to this section.
  3 17 Amounts received shall be in addition to and not supplanting
  3 18 moneys appropriated in section 279.51 and moneys otherwise
  3 19 appropriated by law to supplement that funding.
  3 20    b.  Notwithstanding paragraph "a", a school district which
  3 21 received supplementary weighting for an alternative high
  3 22 school program offered by a community college for the school
  3 23 budget year beginning July 1, 1999, shall receive one hundred
  3 24 percent of that amount for the school budget year beginning
  3 25 July 1, 2000.  Effective for the school budget year beginning
  3 26 July 1, 2001, and for succeeding budget years, a school
  3 27 district which received supplementary weighting for an
  3 28 alternative high school program offered by a community college
  3 29 for the school budget year beginning July 1, 1999, shall
  3 30 receive a twenty-five percent reduction in that amount each
  3 31 year until the amount generated by the supplementary weighting
  3 32 authorized in paragraph "a" is reached.  If, for the school
  3 33 budget year beginning July 1, 2000, and succeeding budget
  3 34 years, the amount generated by the supplementary weighting
  3 35 authorized in paragraph "a" exceeds the amount which would be
  4  1 received pursuant to this paragraph, the amount generated by
  4  2 the supplementary weighting authorized in paragraph "a" may be
  4  3 utilized.
  4  4    5.  SHARED CLASSES DELIVERED OVER THE IOWA COMMUNICATIONS
  4  5 NETWORK.  A pupil attending a class in which students from one
  4  6 or more other school districts are enrolled and which is
  4  7 taught via the Iowa communications network is not deemed to be
  4  8 attending a class in another school district or in a community
  4  9 college for the purposes of this section and the school
  4 10 district is not eligible for supplementary weighting for that
  4 11 class under this section.
  4 12    6.  PUPILS INELIGIBLE.  A pupil eligible for the weighting
  4 13 plan provided in section 256B.9 is not eligible for
  4 14 supplementary weighting pursuant to this section.
  4 15    Sec. 2.  Section 257.12, Code 1999, is repealed.
  4 16    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  4 17 immediate importance, takes effect upon enactment.  
  4 18                           EXPLANATION 
  4 19    This bill provides supplementary weighting for determining
  4 20 enrollment in school districts which are involved in sharing
  4 21 programs on a district-to-district, or district-to-community-
  4 22 college basis, and for alternative high school programs.
  4 23    For purposes of determining the amount of supplementary
  4 24 weighting, pupils in a regular curriculum attending all their
  4 25 classes in the district in which they reside, taught by
  4 26 teachers employed by that district, and having administrators
  4 27 employed by that district, are assigned a weighting of one.
  4 28    The bill provides that school districts which send their
  4 29 resident pupils to another school district, which jointly
  4 30 employ and share the services of teachers under Code section
  4 31 280.15, or which use the services of a teacher employed by
  4 32 another school district, will have assigned to the pupils an
  4 33 additional weighting of .48 of the percentage of the pupil's
  4 34 school day during which the pupil is involved in the shared
  4 35 program.  In order to receive the supplementary weighting, the
  5  1 school budget review committee must certify to the department
  5  2 of management that the shared classes or teachers would
  5  3 otherwise not be implemented without the assignment of
  5  4 additional weighting.
  5  5    The bill also provides that school districts which send
  5  6 their resident pupils to a community college-offered class or
  5  7 to a class taught by a community college-employed teacher will
  5  8 have assigned to the pupils an additional weighting of .48 of
  5  9 the percentage of the pupil's school day during which the
  5 10 pupil is involved in the shared program, if the school budget
  5 11 review committee certifies to the department of management
  5 12 that the class would not otherwise be implemented without the
  5 13 assignment of the supplementary weighting.  The bill provides
  5 14 that a number of requirements must be met regarding the nature
  5 15 of the class or classes being taken in order to qualify for
  5 16 supplementary weighting for programs shared by a district with
  5 17 a community college.
  5 18    The bill additionally provides that school districts will
  5 19 receive supplementary weighting for alternative high school
  5 20 programs.  A weighting of .013 per pupil will be assigned for
  5 21 pupils in grades 11 and 12, based on the number of pupils
  5 22 enrolled in grades one through six who are eligible for free
  5 23 lunches.  The bill provides that enrollment refers to the
  5 24 enrollment reported by the school district on the basic
  5 25 educational data survey for the base year.  The bill provides
  5 26 that amounts received as supplemental weighting for
  5 27 alternative high school pupils shall be utilized by a school
  5 28 district to develop or maintain alternative high school
  5 29 programs within the district, either through facilitation of a
  5 30 program provided by the school district, a shared program with
  5 31 another school district, or a shared program with a community
  5 32 college that would otherwise not receive funding pursuant to
  5 33 this section.  This bill provides that funds received will be
  5 34 in addition to and not supplanting other at-risk program
  5 35 moneys appropriated in Code section 279.51 and moneys
  6  1 otherwise appropriated by law to supplement that funding.  The
  6  2 bill provides that a school district which received
  6  3 supplementary weighting for an alternative high school program
  6  4 offered by a community college for the school budget year
  6  5 beginning July 1, 1999, will receive 100 percent of that
  6  6 amount for the school budget year beginning July 1, 2000, and
  6  7 an amount for succeeding budget years representing a 25
  6  8 percent decrease each year until the amount generated by the
  6  9 supplementary weighting authorized in the bill is reached.
  6 10 The bill further provides that if the amount of supplementary
  6 11 weighting authorized in the bill exceeds these amounts, the
  6 12 amount authorized in the bill may be utilized.
  6 13    The bill provides that pupils attending a class in which
  6 14 students from one or more other school districts are enrolled,
  6 15 which is taught via the Iowa communications network, will not
  6 16 be considered to be attending a class in another school
  6 17 district or in a community college for purposes of qualifying
  6 18 for supplementary weighting.  The bill further provides that
  6 19 pupils eligible for special education weighting pursuant to
  6 20 Code section 256B.9 will not be eligible for supplementary
  6 21 weighting for shared programs between school districts or
  6 22 between a school district and a community college.
  6 23    Additionally, the bill provides for the deletion of
  6 24 provisions which previously authorized supplementary
  6 25 weighting.  The deleted provisions relate to the addition of
  6 26 supplementary weighting amounts for school districts entering
  6 27 into a whole grade sharing agreement pursuant to Code sections
  6 28 282.10 through 282.12 beginning with the budget year beginning
  6 29 on July 1, 1993, and for a five-year period for school
  6 30 districts entering into a whole grade sharing agreement for
  6 31 the budget years beginning July 1, 1991, and July 1, 1992.
  6 32 Also deleted are provisions which had authorized supplementary
  6 33 weighting for a five-year duration for school districts
  6 34 entering into an agreement involving the joint employment of a
  6 35 superintendent for the budget years beginning July 1, 1991,
  7  1 and July 1, 1992, and supplementary weighting for a six-year
  7  2 period for school districts undergoing a reorganization taking
  7  3 effect on or before July 1, 1993.  The bill further deletes
  7  4 previously authorized supplementary weighting for shared
  7  5 mathematics, science, and language classes for the budget
  7  6 years beginning July 1, 1991, and July 1, 1992, and provisions
  7  7 relating to the rounding off of supplementary weighting
  7  8 calculations.
  7  9    The bill takes effect upon enactment.
