  1  1    Section 1.  Section 162.2, subsection 6, Code 1999, is
  1  2 amended to read as follows:
  1  3    6.  "Commercial breeder" means a person, engaged in the
  1  4 business of breeding dogs or cats, who if any of the following
  1  5 applies:
  1  6    a.  The person sells, exchanges, or leases or offers to
  1  7 sell dogs or cats originating from four or more litters
  1  8 produced during any twelve-month period from dogs or cats bred
  1  9 by the person.  A sale means any transfer, exchange, or lease
  1 10 of a dog or cat in return for consideration, or who offers to
  1 11 do so,.  This paragraph applies regardless of whether or not
  1 12 the animals are raised, trained, groomed, or boarded by the
  1 13 person raises, trains, grooms, or boards the dogs or cats.
  1 14    b.  A The person who owns or harbors three or less breeding
  1 15 males or females is not a commercial breeder.  However, a
  1 16 person who breeds or harbors more than three breeding male or
  1 17 female greyhounds for the purposes of using them for pari-
  1 18 mutuel racing shall be considered a commercial breeder
  1 19 irrespective of whether the person sells, leases, or exchanges
  1 20 the greyhounds for consideration or offers to do so.  
  1 21                           EXPLANATION
  1 22    Code chapter 162 regulates persons who maintain animals in
  1 23 commercial establishments, including commercial breeders of
  1 24 dogs and cats.  The Code chapter requires commercial breeders
  1 25 to be licensed by the department of agriculture and land
  1 26 stewardship, unless the person has a federal license.  The
  1 27 bill eliminates an exception from the licensing requirement
  1 28 for persons who own three or fewer breeding animals.  The bill
  1 29 provides that a commercial breeder does not include a person
  1 30 who sells dogs or cats originating from less than four litters
  1 31 in any 12-month period.  The bill makes other changes in order
  1 32 to enhance readability.
