PAG LIN 1 1 Section 1. Section 135.11, Code Supplement 1999, is 1 2 amended by adding the following new subsection: 1 3 NEW SUBSECTION. 26. a. Require that beginning July 1, 1 4 2000, the blood sample taken from a newborn for the purpose of 1 5 screening for birth defects pursuant to chapter 136A shall 1 6 also be used to obtain the blood type of the newborn. The 1 7 laboratory that tests the blood sample shall include the blood 1 8 type information in the notification of results returned to 1 9 the person required to file the birth certificate pursuant to 1 10 section 144.13 or birthing facility. The person required to 1 11 file the birth certificate pursuant to section 144.13 or 1 12 birthing facility shall include the blood type information in 1 13 the newborn's birth certificate registration forwarded to the 1 14 department. 1 15 b. Rules adopted by the department in implementing this 1 16 subsection shall provide for all of the following: 1 17 (1) Alternative procedures for newborn blood typing and 1 18 submission of birth certificate registration information for 1 19 births which are attended by a midwife or which are 1 20 unattended. 1 21 (2) Refusal by a parent or guardian of the blood testing 1 22 for the purpose of blood typing. 1 23 (3) If a blood sample is not taken pursuant to chapter 1 24 136A, and a parent or guardian does not refuse the test, that 1 25 a blood sample may be taken from the newborn's umbilical cord 1 26 for the purpose of blood typing. 1 27 Sec. 2. Section 144.13, Code Supplement 1999, is amended 1 28 by adding the following new subsection: 1 29 NEW SUBSECTION. 5. The certificate of birth for each live 1 30 birth that occurs in this state on or after July 1, 2000, 1 31 which is filed in accordance with this chapter, shall include 1 32 the blood type of the subject of the certificate of birth as 1 33 provided in section 135.11, subsection 26. 1 34 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 1 35 immediate importance, takes effect upon enactment. 2 1 EXPLANATION 2 2 This bill directs the Iowa department of public health to 2 3 require that the blood sample currently taken from newborns 2 4 for the purpose of screening for birth defects shall also be 2 5 used for the blood typing of the newborn. The laboratory 2 6 results of the blood screening are to include the blood type 2 7 and this information is to be returned to the person required 2 8 to file the birth certificate or birthing facility which 2 9 submitted the blood sample. The blood type information is 2 10 required to be included in the birth certificate registration 2 11 information submitted to the department. The rules adopted by 2 12 the department to implement the requirement are to provide 2 13 alternative procedures for unattended births and for births 2 14 attended by midwives, are to provide for refusal of the 2 15 testing for the purpose of blood typing by a parent or 2 16 guardian of the newborn, and are to provide that if a blood 2 17 sample is not taken for the purposes of Code chapter 136A, and 2 18 a parent or guardian does not refuse, the blood from the 2 19 newborn's umbilical cord may be sampled for the purpose of 2 20 blood typing. 2 21 The bill takes effect upon enactment. 2 22 LSB 5009SS 78 2 23 pf/gg/8
