PAG LIN 1 1 Section 1. Section 53.11, Code 1999, is amended to read as 1 2 follows: 1 3 53.11 PERSONAL DELIVERY OF ABSENTEE BALLOT SATELLITE 1 4 ABSENTEE VOTING STATIONS. 1 5 1. The commissioner shall deliver an absentee ballot to 1 6 any registered voter applying in person at the commissioner's 1 7 office, or at any location designated by the commissioner, not 1 8 more than forty days before the date of the general election 1 9 or the primary election, and for all other elections, as soon 1 10 as the ballot is available. The registered voter shall 1 11 immediately mark the ballot, enclose and seal it in a ballot 1 12 envelope, subscribe to the affidavit on the reverse side of 1 13 the envelope, and return the absentee ballot to the 1 14 commissioner. The commissioner shall record the numbers 1 15 appearing on the application and ballot envelope along with 1 16 the name of the registered voter. 1 17 2. Satellite absentee voting stations shall be established 1 18 throughout the cities and county at the direction of the 1 19 commissioner or upon receipt of a petition signed by not less 1 20 than one hundred eligible electors requesting that a satellite 1 21 absentee voting station be established at a location to be 1 22 described on the petition. A satellite absentee voting 1 23 station established by petition must be open at least one day 1 24 for a minimum of six hours. A satellite absentee voting 1 25 station established at the direction of the commissioner or by 1 26 petition may remain open until five p.m. on the day before the 1 27 election. Satellite absentee voting stations may only be 1 28 established at the primary and general elections and at any 1 29 special election held to fill a vacancy in a partisan office. 1 30 3. A petition requesting a satellite absentee voting 1 31 station must be filed by the following deadlines: 1 321a. For a primary or general election, no later than five 1 33 p.m. on the forty-seventh day before the election. 1 342. For the regular city election, no later than five p.m.1 35on the thirtieth day before the election.2 13. For the regular school election, no later than five2 2p.m. on the thirtieth day before the election.2 34b. For a special election to fill a vacancy in a 2 4 partisan office, no later than thirty-two days before the 2 5 special election. 2 6 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 2 7 immediate importance, takes effect upon enactment. 2 8 EXPLANATION 2 9 This bill limits the use of satellite absentee voting 2 10 stations to primary elections, general elections, and special 2 11 elections to fill a vacancy in a partisan office. This amends 2 12 current law which allows satellite absentee voting stations to 2 13 be established for primary and general elections, regular city 2 14 elections, regular school elections, and special elections. 2 15 The bill takes effect upon enactment. 2 16 LSB 2617SV 78 2 17 sc/gg/8
