  1  1    Section 1.  Section 88.14, Code 1999, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  13.  INAPPLICABILITY TO VOLUNTEER FIRE
  1  4 DEPARTMENTS.  This section shall not apply to a volunteer fire
  1  5 department unless the department has one or more employees who
  1  6 are fire fighters.  
  1  7                           EXPLANATION
  1  8    This bill provides that volunteer fire departments are not
  1  9 subject to penalties for violations of Code chapter 88
  1 10 governing occupational safety and health (OSHA).  The bill
  1 11 provides that a fire department with one or more fire fighters
  1 12 who are employees, and not volunteers, is not exempt from the
  1 13 imposition of penalties under OSHA.
