  1  1    Section 1.  Section 692.2, subsection 6, unnumbered
  1  2 paragraph 1, Code 1999, is amended to read as follows:
  1  3    The department may charge a fee to any nonlaw-enforcement
  1  4 person or agency to conduct criminal history data checks.
  1  5 However, the department shall not charge a fee to a law
  1  6 enforcement person or agency, any political subdivision of the
  1  7 state, or a municipal housing agency as defined in section
  1  8 403A.2.  Notwithstanding any other limitation, the department
  1  9 may use revenues generated from the fee to administer this
  1 10 section and other sections of the Code providing access to
  1 11 criminal history data and to employ personnel to process
  1 12 criminal history data checks.
  1 13    Sec. 2.  Section 692.2A, subsection 1, Code 1999, is
  1 14 amended to read as follows:
  1 15    1.  A criminal history data check prepayment fund is
  1 16 created in the state treasury under the control of the
  1 17 department for the purpose of allowing any non-law enforcement
  1 18 agency or a person or agency to deposit moneys as an advance
  1 19 on fees required to conduct criminal history data checks as
  1 20 provided in section 692.2.  
  1 21                           EXPLANATION 
  1 22    This bill provides that the department of public safety may
  1 23 not charge a fee to a political subdivision of the state or a
  1 24 municipal housing agency to conduct a criminal history check.
  1 25 Under current law, the department is prohibited only from
  1 26 charging a fee to a law enforcement person or agency.
