PAG LIN 1 1 1 2 SENATE FILE 254 1 3 1 4 AN ACT 1 5 RELATING TO THE EMERGENCY MANAGEMENT DIVISION OF THE 1 6 DEPARTMENT OF PUBLIC DEFENSE BY AUTHORIZING FEES FOR 1 7 RADIOLOGICAL DETECTION EQUIPMENT MAINTENANCE SERVICES, 1 8 BY AUTHORIZING FINANCIAL ASSISTANCE TO LOCAL GOVERNMENTS 1 9 FOR EMERGENCY MANAGEMENT PURPOSES, BY DIRECTING A REPORT 1 10 TO THE GENERAL ASSEMBLY BY THE DIVISION DIRECTOR, AND BY 1 11 PROVIDING AN EFFECTIVE DATE. 1 12 1 13 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 14 1 15 DIVISION I 1 16 Section 1. Section 23A.2, subsection 10, Code 1999, is 1 17 amended by adding the following new paragraph: 1 18 NEW PARAGRAPH. m. The repair, calibration, or maintenance 1 19 of radiological detection equipment by the emergency 1 20 management division of the department of public defense. 1 21 Sec. 2. Section 29C.8, Code 1999, is amended by adding the 1 22 following new subsection: 1 23 NEW SUBSECTION. 5. The emergency management division may 1 24 charge fees for the repair, calibration, or maintenance of 1 25 radiological detection equipment and may expend funds in 1 26 addition to funds budgeted for the servicing of the 1 27 radiological detection equipment. The division shall adopt 1 28 rules pursuant to chapter 17A providing for the establishment 1 29 and collection of fees for radiological detection equipment 1 30 repair, calibration, or maintenance services and for entering 1 31 into agreements with other public and private entities to 1 32 provide the services. Fees collected for repair, calibration, 1 33 or maintenance services shall be treated as repayment receipts 1 34 as defined in section 8.2 and shall be used for the operation 1 35 of the division's radiological maintenance facility or 2 1 radiation incident response training. 2 2 DIVISION II 2 3 Sec. 3. Section 29C.6, subsection 17, Code 1999, is 2 4 amended to read as follows: 2 5 17. a. When the president of the United States has 2 6 declared a major disaster to exist in the state and upon the 2 7 governor's determination that financial assistance is 2 8 essential to meet disaster-related necessary expenses or 2 9 serious needs of local and state government adversely affected 2 10 by a major disaster that cannot be otherwise adequately met 2 11 from other means of assistance, accept a grant by the federal 2 12 government to fund the financial assistance, subject to terms 2 13 and conditions imposed upon the grant, and enter into an 2 14 agreement with the federal government pledging the state to 2 15 participate in the funding of the financial assistance 2 16 authorized to local government and eligible private nonprofit 2 17 agencies in an amount not to exceed ten percent of the total 2 18 eligible expenses, with the applicant providingfifteen2 19percentthe balance of any participation amount. If financial 2 20 assistance is granted by the federal government for state 2 21 disaster-related expenses or serious needs, the state shall 2 22 participate in the funding of the financial assistance 2 23 authorized in an amount not to exceed twenty-five percent of 2 24 the total eligible expenses. If financial assistance is 2 25 granted by the federal government for hazard mitigation, the 2 26 state may participate in the funding of the financial 2 27 assistance authorized to a local government in an amount not 2 28 to exceed ten percent of the eligible expenses, withlocal2 29governmentthe applicant providingforty percentthe balance 2 30 of any participation amount. If financial assistance is 2 31 granted by the federal government for state-related hazard 2 32 mitigation, the state may participate in the funding of the 2 33 financial assistance authorized, not to exceed fifty percent 2 34 of the total eligible expenses. If state funds are not 2 35 otherwise available to the governor, an advance of the state 3 1 share may be accepted from the federal government to be repaid 3 2 when the state is able to do so. 3 3 b. State participation in funding financial assistance 3 4 under paragraph "a" is contingent upon the local government 3 5 having on file a state-approved, comprehensive, countywide 3 6 emergency operations plan which meets the standards adopted 3 7 pursuant to section 29C.9, subsection 8. 3 8 Sec. 4. EFFECTIVE DATE. This division of this Act takes 3 9 effect July 1, 2000. 3 10 DIVISION III 3 11 Sec. 5. The general assembly recognizes the need for the 3 12 state government to be prepared to respond to incidents 3 13 involving nuclear, chemical, or biological materials. 3 14 Further, the general assembly recognizes that the emergency 3 15 management division of the department of public defense should 3 16 take the lead in these efforts. Therefore, the administrator 3 17 of the emergency management division is directed to report to 3 18 the general assembly not later than January 15, 2000, 3 19 regarding the status of state government preparedness to 3 20 respond to nuclear, chemical, or biological materials 3 21 incidents and identify unmet needs for preparedness and 3 22 response efforts. 3 23 3 24 3 25 3 26 MARY E.
