1 1 Section 1. NEW SECTION. 306C.13A LOCAL CONTROL IN
1 2 HISTORIC CITIES.
1 3 1. A city in which a majority of the buildings in the city
1 4 are listed on the national register of historic buildings is
1 5 exempt from the provisions of this division of this chapter or
1 6 of another chapter which relate to the adoption of an
1 7 ordinance containing a city plan for the erection and
1 8 maintenance of advertising devices. The city may adopt its
1 9 own plan and shall consult with the department during the
1 10 development of such plan. The plan must comply with the
1 11 requirements of the federal Highway Beautification Act, 23
1 12 U.S.C. ch. 131.
1 13 2. The state is not liable for damages resulting from the
1 14 placement of advertising devices pursuant to this section
1 15 which are not in compliance with other provisions of this
1 16 chapter. A city which adopts its own plan pursuant to this
1 17 section shall assume the liability for any damages caused by
1 18 signs which do not comply with the manual on uniform traffic-
1 19 control devices adopted under section 321.252.
1 20 EXPLANATION
1 21 This bill authorizes a city which has a majority of its
1 22 buildings listed on the national register of historic
1 23 buildings to adopt its own plan for controlling the erection
1 24 and maintenance of advertising devices, which include signs,
1 25 billboards, and posters. The plan must comply with the
1 26 federal Highway Beautification Act, 23 U.S.C. ch. 131. The
1 27 city must consult with the state department of transportation
1 28 regarding the plan; however, the state is not liable for any
1 29 damages caused by advertising devices which are erected and
1 30 are not in compliance with department regulations. The city
1 31 assumes the liability for damages caused by signs which do not
1 32 comply with the state department of transportation's manual on
1 33 uniform traffic-control devices.
