1 1 Section 1. Section 717B.2, unnumbered paragraph 1, Code
1 2 1999, is amended to read as follows:
1 3 A person is guilty of animal abuse if the person
1 4 intentionally injures, maims, disfigures, or destroys an
1 5 animal owned by another person, in any manner, including
1 6 intentionally poisoning the animal. A person guilty of animal
1 7 abuse is guilty of an aggravated misdemeanor. In addition to
1 8 the penalty provided under section 903.1, the court shall
1 9 order a person who is convicted of a violation of this section
1 10 to attend and complete court-approved counseling sessions or a
1 11 court-approved counseling program. This section shall not
1 12 apply to any of the following:
1 13 Sec. 2. Section 901.5, subsection 8, Code 1999, is amended
1 14 by adding the following new unnumbered paragraph:
1 15 NEW UNNUMBERED PARAGRAPH. In addition to any sentence
1 16 imposed pursuant to chapter 902 or 903, the court may order
1 17 the defendant to attend and complete any court-approved
1 18 counseling sessions or a court-approved counseling program
1 19 ordered pursuant to section 717B.2 or any other section.
1 20 EXPLANATION
1 21 This bill makes changes in the penalty applicable to animal
1 22 abuse by requiring that, in addition to the penalty which is
1 23 generally applicable to aggravated misdemeanors, the person
1 24 must also attend and complete court-approved counseling. A
1 25 corresponding amendment is made to Code section 901.5. An
1 26 aggravated misdemeanor is punishable by imprisonment not to
1 27 exceed two years and a fine of at least $500 but not more than
1 28 $5,000.
