  1  4 RELATING TO THE ADMINISTRATION OF THE STATE DEPARTMENT OF
  1  5    TRANSPORTATION BY ALLOWING THE USE OF REVERTING OPERATING
  1  6    FUNDS FOR TRAINING AND TECHNOLOGY, MAKING AN APPROPRIATION,
  1  7    AND PROVIDING FOR THE NONREVERSION OF CERTAIN RAILROAD FUNDS
  1  8    AND PROVIDING AN EFFECTIVE DATE.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11 
  1 12    Section 1.  NEW SECTION.  307.46  USE OF REVERSIONS.
  1 13    1.  Notwithstanding the provisions of section 8.33 or any
  1 14 other provision of law to the contrary, if on June 30 of a
  1 15 fiscal year a balance of an operational appropriation remains
  1 16 unexpended or unencumbered, not more than fifty percent of the
  1 17 balance may be encumbered by the department and used as
  1 18 provided in this section and the remaining balance shall be
  1 19 deposited in the fund from which the money was appropriated.
  1 20 The department shall not encumber an amount in excess of five
  1 21 hundred thousand dollars under this section in any fiscal
  1 22 year.  Moneys encumbered under this section shall be used by
  1 23 the department during the succeeding fiscal year for employee
  1 24 training and for technology enhancement.  Moneys which are
  1 25 encumbered under this section but not used shall revert to the
  1 26 fund from which the money was appropriated on June 30 of the
  1 27 succeeding fiscal year.
  1 28    2.  On or before June 30 of the fiscal year following the
  1 29 fiscal year in which funds were encumbered under this section,
  1 30 the department shall report to the joint transportation,
  1 31 infrastructure, and capitals appropriations subcommittee, the
  1 32 legislative fiscal bureau, the department of management, and
  1 33 the legislative fiscal and oversight committees of the
  1 34 legislative council detailing how the moneys were expended.
  1 35 Moneys shall not be encumbered under this section from an
  2  1 appropriation which received a transfer from another
  2  2 appropriation pursuant to section 8.39.
  2  3    3.  For purposes of this section, "operational
  2  4 appropriation" means an appropriation from the road use tax
  2  5 fund or primary road fund providing for salaries, support,
  2  6 maintenance, and miscellaneous purposes.
  2  7    Sec. 2.  There is appropriated from the road use tax fund
  2  8 to the state department of transportation for the fiscal year
  2  9 beginning July 1, 1999, and ending June 30, 2000, the
  2 10 following amount, or so much thereof as is necessary, for the
  2 11 purpose designated:
  2 12    For costs associated with the county issuance of driver's
  2 13 licenses:  
  2 14 .................................................. $    308,000
  2 15    Sec. 3.  REVERSION OF GRANT FUNDING.  Notwithstanding
  2 16 section 8.33 and 1994 Iowa Acts, chapter 1199, section 8, the
  2 17 funds transferred to the railway finance authority for a
  2 18 community assistance grant in 1994 Iowa Acts, chapter 1199,
  2 19 section 8, subsection 7, shall not revert, but shall be
  2 20 transferred to the railroad revolving loan fund established in
  2 21 section 327H.20A.
  2 22    Sec. 4.  ASSISTANCE FOR RAILROAD CLOSE-CLEARANCE WARNING
  2 23 DEVICES.  Notwithstanding any contrary provision in section
  2 24 327H.20A, the state department of transportation may use
  2 25 moneys in the railroad revolving loan fund to erect close-
  2 26 clearance warning devices along railroad rights of way when
  2 27 necessary.
  2 28    Sec. 5.  EFFECTIVE DATE.  Section 1 of this Act, being
  2 29 deemed of immediate importance, takes effect upon enactment.
