PAG LIN 1 1 Section 1. Section 455A.19, subsection 1, paragraph b, 1 2 subparagraphs (3), (4), (5), and (8), Code 1999, are amended 1 3 to read as follows: 1 4 (3) Forty percent of the allocation to the county 1 5 conservation account annually shall be held in an account in 1 6 the state treasury for the natural resource commission to 1 7 award to counties or utility boards created pursuant to 1 8 chapter 388 on a competitive grant basis by a project 1 9 selection committee established in this subparagraph. Local 1 10 matching funds are not required for grants awarded under this 1 11 subparagraph. The project planning and review committee shall 1 12 be composed of two staff members of the department and two 1 13 county conservation board directors appointed by the director 1 14 and a fifth member selected by a majority vote of the 1 15 director's appointees. The natural resource commission, by 1 16 rule, shall establish procedures for application, review, and 1 17 selection of county and utility board projects submitted for 1 18 funding. Upon recommendation of the project planning and 1 19 review committee, the director shall award the grants. 1 20 (4) Funds allocated to the counties or to utility boards 1 21 created pursuant to chapter 388 undersubparagraphs1 22 subparagraph (1), (2),andor (3) may be used for land 1 23 easements or acquisitions, capital improvements, stabilization 1 24 and protection of resources, repair and upgrading of 1 25 facilities, environmental education, and equipment. However, 1 26 expenditures are not allowed for single or multipurpose 1 27 athletic fields, baseball or softball diamonds, tennis courts, 1 28 golf courses, swimming pools, and other group or organized 1 29 sport facilities. Funds may be used for county or utility 1 30 board projects located within the boundaries of a city. 1 31 (5) Funds allocated to counties pursuant to subparagraphs 1 32 (2) and (3) shall only be allocated to counties dedicating 1 33 property tax revenue at least equal to twenty-two cents per 1 34 thousand dollars of the assessed value of taxable property in 1 35 the county to county conservation purposes. State funds 2 1 received under this paragraph shall not reduce or replace 2 2 county tax revenues appropriated for county conservation 2 3 purposes. The county auditor shall submit documentation 2 4 annually of the dedication of property tax revenue for county 2 5 conservation purposes. The annual audit of the financial 2 6 transactions and condition of a county shall certify 2 7 compliance with requirements of this subparagraph. Funds not 2 8 allocated to counties not qualifying for the allocations under 2 9 subparagraph (2) as a result of this subparagraph shall be 2 10 held in reserve for each county for two years. Counties 2 11 qualifying within two years may receive the funds held in 2 12 reserve. Funds not spent by a county within two years shall 2 13 revert to the general pool of county funds for reallocation to 2 14 other counties where needed. 2 15 (8) Any funds received by a county or a utility board 2 16 created pursuant to chapter 388 under this paragraph may be 2 17 used to match other state or federal funds, and multicounty or 2 18 multiagency projects may be funded under this paragraph. 2 19 Sec. 2. Section 455A.19, subsection 1, paragraph d, Code 2 20 1999, is amended to read as follows: 2 21 d. Fifteen percent shall be allocated to a cities' parks 2 22 and open space account. The moneys allocated in this 2 23 paragraph may be used to fund competitive grants to cities or 2 24 utility boards created pursuant to chapter 388 to acquire, 2 25 establish, and maintain natural parks, preserves, and open 2 26 spaces. The grants may include expenditures for multipurpose 2 27 trails, restroom facilities, shelter houses, and picnic 2 28 facilities, but expenditures for single or multipurpose 2 29 athletic fields, baseball or softball diamonds, tennis courts, 2 30 golf courses, swimming pools, and other group or organized 2 31 sport facilities requiring specialized equipment are excluded. 2 32 The grants may be used for city or utility board projects 2 33 located outside of a city's boundaries. The natural resource 2 34 commission, by rule, shall establish procedures for 2 35 application, review, and selection of city or utility board 3 1 projects on a competitive basis. The rules shall provide for 3 2 three categories of cities based on population within which 3 3 the cities and utility boards shall compete for grants. There 3 4 is appropriated from the cities' parks and open space account 3 5 to the department the amount in that account, or so much 3 6 thereof as is necessary, to carry out the competitive grant 3 7 program as provided in this paragraph. 3 8 Sec. 3. Section 455A.20, subsection 1, paragraph b, Code 3 9 1999, is amended to read as follows: 3 10 b. The mayor or the mayor's designee of each city in a 3 11 county. The mayor's designee shall be a member of the city 3 12 council or utility board created pursuant to chapter 388. If 3 13 a city is located in more than one county, the membership 3 14 shall be on the county committee of the county in which the 3 15 largest population of the city resides. 3 16 Sec. 4. Section 455A.20, subsection 2, Code 1999, is 3 17 amended to read as follows: 3 18 2. The duties of the county resource enhancement committee 3 19 are to coordinate the resource enhancement program, plans, and 3 20 proposed projects developed by cities, utility boards created 3 21 pursuant to chapter 388, county conservation board, and soil 3 22 and water conservation district commissioners for funding 3 23 under this division. The county committee shall review and 3 24 comment upon all projects before they are submitted for 3 25 funding under section 455A.19. Each county committee shall 3 26 propose a five-year program plan which includes a one-year 3 27 proposed expenditure plan and submit it to the department. 3 28 Sec. 5. EFFECTIVE DATE. This Act, being deemed of 3 29 immediate importance, takes effect upon enactment. 3 30 EXPLANATION 3 31 This bill provides that a city utility board created under 3 32 Code chapter 388 may apply for funds from the county 3 33 conservation account or the cities' parks and open space 3 34 account of the resources enhancement and protection (REAP) 3 35 fund on a competitive basis with county and city open space, 4 1 park, and preserve projects. The bill also allows the mayor's 4 2 designee for membership on the county resource enhancement 4 3 committee to be a member of a city utility board or a member 4 4 of the city council. 4 5 This bill takes effect upon enactment. 4 6 LSB 1759XS 78 4 7 tj/cf/24
