1 3 AN ACT
1 4 TO LEGALIZE THE TRANSFER OF CERTAIN PROPERTY BY THE JOINT
1 5 COUNTY SYSTEM OF BLACK HAWK AND BUCHANAN COUNTIES TO THE
1 6 INDEPENDENCE COMMUNITY SCHOOL DISTRICT, AND PROVIDING AN
1 7 EFFECTIVE DATE.
1 8 WHEREAS, 1974 Iowa Acts, chapter 1273, was enacted by the
1 9 general assembly, approved by the governor, and became law;
1 10 and
1 11 WHEREAS, 1974 Iowa Acts, chapter 1273, legalized,
1 12 validated, and confirmed all acts and proceedings taken by the
1 13 board of directors of the joint county system of Black Hawk
1 14 and Buchanan counties in connection with the transfer from the
1 15 joint county system of Black Hawk and Buchanan counties to the
1 16 Independence community school district of property described
1 17 as follows:
1 18 Commencing at a point thirty-nine (39) rods west of the
1 19 southeast corner of the southeast quarter (SE 1/4) of section
1 20 thirty-three (33), township eighty-nine (89) north, range nine
1 21 (9) west of the 5th P.M. in Buchanan county, Iowa, running
1 22 thence north three hundred thirty (330) feet, thence west two
1 23 hundred (200) feet to the place of beginning; and
1 24 WHEREAS, 1974 Iowa Acts, chapter 1273, incorrectly
1 25 described the property; and
1 26 WHEREAS, it is deemed advisable and necessary to enact a
1 27 legalizing act to correct the error in the description to put
1 28 to rest any doubts that may arise concerning the transfer of
1 29 the property to the Independence community school district;
1 30 NOW THEREFORE,

1 32 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 34 Section 1. All acts and proceedings taken by the board of
1 35 directors of the joint county system of Black Hawk and
2 1 Buchanan counties in connection with the transfer from the
2 2 joint county system of Black Hawk and Buchanan counties to the
2 3 Independence community school district of the following
2 4 described property are legalized, validated, and confirmed:
2 5 Commencing at a point thirty-nine (39) rods west of the
2 6 southeast corner of the southeast quarter (SE 1/4) of section
2 7 thirty-three (33), township eighty-nine (89) north, range nine
2 8 (9) west of the 5th P.M. in Buchanan county, Iowa, running
2 9 thence north three hundred thirty (330) feet, thence west two
2 10 hundred (200) feet, thence south three hundred thirty (330)
2 11 feet, thence east two hundred (200) feet, to the place of
2 12 beginning.
2 13 Sec. 2. The quitclaim deed for the transfer of the
2 14 property described in section 1 of this Act, signed by the
2 15 president of the board of directors of the joint county system
2 16 of Black Hawk and Buchanan counties, and which has been
2 17 recorded, is legalized, validated, and confirmed.
2 18 Sec. 3. This Act, being deemed of immediate importance,
2 19 takes effect upon its enactment.
