PAG LIN 1 1 Section 1. Section 483A.7, subsection 3, Code 1999, is 1 2 amended to read as follows: 1 3 3. A nonresident wild turkey hunter is required to have 1 4 only a nonresident wild turkey hunting license and pay the 1 5 wildlife habitat fee.The commission shall annually limit to1 6two thousand licenses the number of nonresidents allowed to1 7have wild turkey hunting licenses.Upon application with 1 8 proof of ownership of land in this state and payment of the 1 9 applicable fees, the department shall issue a nonresident wild 1 10 turkey license to the applicant. The number of nonresident 1 11 wild turkey hunting licenses shall be determined as provided 1 12 in section 481A.38. The commission shall allocate the 1 13 nonresident wild turkey hunting licenses issued among the 1 14 zones based on the populations of wild turkey. A nonresident 1 15 applying for a wild turkey hunting license must exhibit proof 1 16 of having successfully completed a hunter safety and ethics 1 17 education program as provided in section 483A.27 or its 1 18 equivalent as determined by the department before the license 1 19 is issued. 1 20 Sec. 2. Section 483A.8, subsection 3, Code 1999, is 1 21 amended to read as follows: 1 22 3. A nonresident hunting deer is required to have a 1 23 nonresident deer license and must pay the wildlife habitat 1 24 fee.The commission shall annually limit to seven thousand1 25five hundred licenses the number of nonresidents allowed to1 26have deer hunting licenses. Of the first six thousand1 27nonresident deer licenses issued, not more than thirty-five1 28percent of the licenses shall be bow season licenses and,1 29after the first six thousand nonresident deer licenses have1 30been issued, all additional licenses shall be issued for1 31antlerless deer only.Upon application with proof of 1 32 ownership of land in this state and payment of the applicable 1 33 fees, the department shall issue a nonresident deer hunting 1 34 license to the applicant. The number of nonresident deer 1 35 hunting licenses shall be determined as provided in section 2 1 481A.38. The commission shall allocate the nonresident deer 2 2 hunting licenses issued among the zones based on the 2 3 populations of deer. However, a nonresident applicant may 2 4 request one or more hunting zones, in order of preference, in 2 5 which the applicant wishes to hunt. If the request cannot be 2 6 fulfilled, the applicable fees shall be returned to the 2 7 applicant. A nonresident applying for a deer hunting license 2 8 must exhibit proof of having successfully completed a hunter 2 9 safety and ethics education program as provided in section 2 10 483A.27 or its equivalent as determined by the department 2 11 before the license is issued. 2 12 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 13 immediate importance, takes effect upon enactment. 2 14 EXPLANATION 2 15 This bill strikes the maximum number of deer hunting 2 16 licenses and wild turkey hunting licenses which may be issued 2 17 annually to nonresident hunters. Under current law, the 2 18 maximum number of wild turkey hunting licenses for 2 19 nonresidents is 2,000 annually and the maximum number of deer 2 20 hunting licenses for nonresidents is 7,500 annually. The bill 2 21 also removes the allocations of nonresident deer hunting 2 22 licenses for bow seasons and for antlerless deer licenses 2 23 only. 2 24 The bill also requires, upon application with proof of 2 25 ownership and payment of applicable fees, the department of 2 26 natural resources to issue a deer hunting license and a wild 2 27 turkey hunting license to a nonresident who owns land in this 2 28 state. 2 29 This bill takes effect upon enactment. 2 30 LSB 1659SV 78 2 31 tj/gg/8
