  1  1    Amend Senate File 2432 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 422.45, Code Supplement 1999,
  1  5 is amended by adding the following new subsection:
  1  6    NEW SUBSECTION.  28.  a.  The gross receipts from
  1  7 the sale or rental of the portion of central office
  1  8 equipment or transmission equipment primarily used by
  1  9 telecommunications providers to provide advanced
  1 10 services in rural areas.  "Advanced services" shall be
  1 11 defined in rules by the utilities board.
  1 12 "Telecommunications provider" includes but is not
  1 13 limited to local exchange carriers and competitive
  1 14 local exchange service providers as defined in section
  1 15 476.96; franchised cable television operators, mutual
  1 16 companies, municipal utilities, cooperatives, and
  1 17 companies furnishing communications services which are
  1 18 not subject to rate regulation as provided in chapter
  1 19 476; long distance companies as defined in section
  1 20 477.10; or commercial mobile radio service, as defined
  1 21 in 47 C.F.R. } 20.3, furnishing telecommunication
  1 22 services on a commercial basis.  For the purposes of
  1 23 this subsection, "central office equipment" means
  1 24 equipment utilized in the initiating, processing,
  1 25 amplifying, switching, or monitoring of
  1 26 telecommunication services.  "Central office
  1 27 equipment" also includes ancillary equipment and
  1 28 apparatus which supports, regulates, controls,
  1 29 repairs, tests, or enables central office equipment to
  1 30 accomplish its function.  "Rural areas" means areas
  1 31 not within five miles of any incorporated or census
  1 32 designated places containing more than twenty-five
  1 33 thousand people.  "Transmission equipment" means
  1 34 equipment through which information is transmitted
  1 35 including, but not limited to, wire, coaxial cable,
  1 36 fiber optics, air or vacuum, and satellites.
  1 37    b.  The tax paid on the gross receipts from sales
  1 38 or rentals described in paragraph "a" must be applied
  1 39 for not later than one year after the sale or rental
  1 40 occurred, in the manner and on the forms provided by
  1 41 the department.  Refunds authorized shall accrue
  1 42 interest at the rate in effect under section 421.7
  1 43 from the first day of the second calendar month
  1 44 following the date the refund claim is received by the
  1 45 department.
  1 46    Sec.    .  EFFECTIVE DATE.  This Act takes effect
  1 47 July 1, 2001."
