  1  1    Amend Senate File 2452 as follows:
  1  2    #1.  Page 17, by inserting before line 8 the
  1  3 following:  
  1  4                      "DIVISION    
  1  5        MOTOR VEHICLE FRANCHISES – CONDITIONS BARRING
  1  6                   CHANGE IN FRANCHISE
  1  7    Sec.    .  Section 322A.11, Code 1999, is amended
  1  8 by adding the following new subsection:
  1  9    NEW SUBSECTION.  5.  The fact that the dealership
  1 10 does not meet an index or standard established by the
  1 11 franchiser, unless the franchiser proves that the
  1 12 failure of the dealership to meet the index or
  1 13 standard will be substantially detrimental to the
  1 14 distribution of the franchiser's motor vehicles in the
  1 15 community."
  1 16    2.  By renumbering as necessary.
