1 5 "Sec. . Section 453A.39, Code 1999, is amended
1 6 by striking the section and inserting in lieu thereof
1 7 the following:
1 8 453A.39 TOBACCO PRODUCTS, CIGARETTES –
1 9 PROHIBITIONS.
1 10 In order to promote the tobacco use prevention and
1 11 control partnership established in section 142A.1, the
1 12 following persons shall comply with the following, as
1 13 applicable:
1 14 1. A manufacturer, distributor, wholesaler,
1 15 retailer, or distributing agent or agent thereof shall
1 16 not give away cigarettes or tobacco products.
1 17 2. A manufacturer, distributor, wholesaler,
1 18 retailer, or distributing agent or agent thereof shall
1 19 not provide free articles, products, commodities,
1 20 gifts, or concessions in any exchange for the purchase
1 21 of cigarettes or tobacco products.
1 22 3. The prohibitions in this section do not apply
1 23 to transactions between manufacturers, distributors,
1 24 wholesalers, or retailers."
