  2 26 2000, is appropriated to the department of agriculture

  2 29 chapter 161, if enacted in 2000 Iowa Acts, Senate File

  2 35    "Sec. 301.  DEPARTMENT OF AGRICULTURE.  There is
  2 36 appropriated from the general fund of the state to the
  2 37 department of agriculture and land stewardship, for
  2 38 the fiscal year beginning July 1, 1999, and ending
  2 39 June 30, 2000, the following amount, or so much
  2 40 thereof as may be necessary, to be used for the
  2 41 purpose designated:
  2 42    To support the administrative division:  
  2 43 .................................................. $     75,000
  2 44    Notwithstanding section 8.33, moneys appropriated
  2 45 in this section which remain unobligated or unexpended
  2 46 at the close of the fiscal year shall not revert but
  2 47 shall remain available to be used for the purpose
  2 48 designated in the succeeding fiscal year."
  2 49    #21.  Page 16, by inserting before line 31, the
  2 50 following:
  3  1    "Sec.    .  STATE FIRE MARSHAL'S OFFICE.  In
  3  2 addition to any allocation of full-time equivalent
  3  3 positions authorized by the Seventy-eighth General
  3  4 Assembly during the 2000 Session for the state fire
  3  5 marshal's office, for the fiscal year beginning July
  3  6 1, 2000, and ending June 30, 2001, 1.00 additional FTE
  3  7 position is authorized for the office for inspections
  3  8 of aboveground petroleum storage tanks."
  3  9    #22.  Page 16, by inserting after line 32, the
  3 10 following:
  3 11    "Sec.      PILOT PROJECT FOR REFUND OF APPLICATION
  3 12 FEES BY THE DEPARTMENT OF NATURAL RESOURCES.
  3 13    1.  The department of natural resources may
  3 14 establish a pilot project for the refund of all or a
  3 15 portion of fees required to be paid to the department
  3 16 for issuing a stormwater discharge permit pursuant to
  3 17 section 455B.103A, if the department fails to issue
  3 18 the permit in a manner and within a period of time
  3 19 customary for issuing such permits.  However, the
  3 20 department is not required to refund any amount of a
  3 21 fee if the failure to issue the permit is primarily
  3 22 caused by the applicant, including the applicant's
  3 23 failure to comply with legal requirements, furnish a
  3 24 completed application or document, or cooperate with
  3 25 the department as required of applicants by the
  3 26 department.
  3 27    2.  The department of natural resources shall adopt
  3 28 rules as necessary in order to establish and
  3 29 administer this section.
  3 30    3.  The department may consider a decision not to
  3 31 issue a refund under this section as a final agency
  3 32 action which is not subject to a contested case
  3 33 proceeding or further agency review under chapter
  3 34 17A."
  3 35    #23.  Page 16, by inserting after line 32 the
  3 36 following:
  3 37    "Sec. 201.  1999 Iowa Acts, chapter 204, section
  3 38 15, subsection 4, paragraph a, is amended by striking
  3 39 the paragraph."
  3 40    #24.  Page 17, by inserting after line 27 the
  3 41 following:
  3 42    "Sec.    .  Section 101.22, subsection 4, Code
  3 43 1999, is amended to read as follows:
  3 44    4.  The registration notice of the owner or
  3 45 operator to the state fire marshal under subsections 1
  3 46 through 3 shall be accompanied by a fee of ten fifteen
  3 47 dollars for each tank included in the notice.  All
  3 48 moneys collected shall be deposited in the general
  3 49 fund retained by the department of public safety and
  3 50 are appropriated for the use of the state fire
  4  1 marshal.  The annual renewal fee applies to all owners
  4  2 or operators who filed a registration notice with the
  4  3 state fire marshal pursuant to subsections 1 through
  4  4 3.
  4  5    Sec.    .  Section 101.24, subsection 1, unnumbered
  4  6 paragraph 1, Code 1999, is amended to read as follows:
  4  7    Inspect and investigate the facilities and records
  4  8 of owners and operators of aboveground petroleum
  4  9 storage tanks with a capacity of fifteen thousand or
  4 10 more gallons, as necessary to determine compliance
  4 11 with this division and the rules adopted pursuant to
  4 12 this division.  An inspection or investigation shall
  4 13 be conducted subject to subsection 4.  For purposes of
  4 14 developing a rule, maintaining an accurate inventory,
  4 15 or enforcing this division, the department may:"
  4 16    #25.  Page 18, line 13, by striking the word
  4 17 "RELATIONS" and inserting the following:  "TRAVEL".
  4 18    #26.  Page 18, line 15, by striking the word
  4 19 "relations" and inserting the following:  "travel".
  4 20    #27.  Page 18, by striking lines 26 through 32, and
  4 21 inserting the following:  "pay the costs incurred by
  4 22 the secretary of agriculture, or a designee of the
  4 23 secretary of agriculture, related to international
  4 24 travel when promoting the sale of Iowa agricultural
  4 25 commodities and Iowa agricultural products, including
  4 26 but not limited to travel fares, accommodations, and
  4 27 meals."
  4 28    #28.  Page 19, by inserting after line 1 the
  4 29 following:
  4 30    "Sec.    .  Section 214A.1, Code 1999, is amended
  4 31 by adding the following new subsections:
  4 32    NEW SUBSECTION.  2A.  "Motor vehicle fuel storage
  4 33 tank" means an aboveground or belowground container
  4 34 that is a fixture, used to keep an accumulation of
  4 35 motor vehicle fuel.
  4 36    NEW SUBSECTION.  2B.  "MTBE" means methyl tertiary
  4 37 butyl ether.
  4 38    NEW SUBSECTION.  4A.  "Sell" means to sell or to
  4 39 offer for sale.
  4 40    Sec.    .  Section 214A.2, subsection 4, Code
  4 41 Supplement 1999, is amended to read as follows:
  4 42    4.  Gasoline Motor vehicle fuel shall not contain
  4 43 methanol without an equal amount of cosolvent, and
  4 44 shall not contain more than five percent methanol more
  4 45 than trace amounts of MTBE, as provided in section
  4 46 214A.18.
  4 47    Sec.    .  Section 214A.16, Code 1999, is amended
  4 48 to read as follows:
  4 49    214A.16  NOTICE OF BLENDED FUEL – DECAL.
  4 50    All If motor vehicle fuel kept, offered, or exposed
  5  1 for sale, or sold at retail containing over one
  5  2 percent ethanol, methanol, or any combination of
  5  3 oxygenate octane enhancers shall be identified as
  5  4 "with" either "ethanol", "methanol",
  5  5 "ethanol/methanol", or similar wording on containing a
  5  6 renewable fuel is sold from a motor vehicle fuel pump,
  5  7 the pump shall have affixed a decal identifying the
  5  8 name of the renewable fuel.  All diesel fuel kept,
  5  9 offered, or exposed for sale, or sold at retail
  5 10 containing over one percent soybean oil by volume
  5 11 shall be identified as "with soydiesel" or similar
  5 12 wording on a decal.  The decal may be different based
  5 13 on the type of renewable fuel used.  The design and
  5 14 location of the decals decal shall be prescribed by
  5 15 rules adopted by the department.  The department shall
  5 16 adopt the rules to be effective by January 1, 1995.  A
  5 17 decal identifying a renewable fuel shall be consistent
  5 18 with standards adopted pursuant to section 159A.6.
  5 19 Until the department establishes standards for decals,
  5 20 the wording shall be on a white adhesive decal with
  5 21 black letters at least one-half inch high and at least
  5 22 one-quarter inch wide placed between thirty and forty
  5 23 inches above the driveway level on the front sides of
  5 24 any container or pump from which the motor fuel is
  5 25 sold.  The department may approve an application to
  5 26 place a decal in a special location on a pump or
  5 27 container or use a decal with special lettering or
  5 28 colors, if the decal appears clear and conspicuous to
  5 29 the consumer.  The application shall be made in
  5 30 writing pursuant to procedures adopted by the
  5 31 department.  Designs for a decal identifying a
  5 32 renewable fuel shall be consistent with standards
  5 33 adopted pursuant to section 159A.6.
  5 34    Sec.    .  NEW SECTION.  214A.18  MTBE PROHIBITION.
  5 35    1.  A person shall not do any of the following:
  5 36    a.  Sell motor vehicle fuel containing more than
  5 37 trace amounts of MTBE in this state.
  5 38    b.  Store motor vehicle fuel containing more than
  5 39 trace amounts of MTBE in a motor vehicle fuel storage
  5 40 tank located in this state.
  5 41    2.  As used in this section, "trace amounts" means
  5 42 not more than one-half of one percent by volume."
  5 43    #29.  Page 19, by inserting after line 3 the
  5 44 following:
  5 45    "Sec.    .  DELAYED EFFECTIVE DATES.  The following
  5 46 provisions of this Act take effect on January 1, 2001:
  5 47    1.  The amendments to sections 214A.1 and 214A.2,
  5 48 in this Act.
  5 49    2.  Section 214A.18, as enacted by this Act.
  5 50    3.  Section 201 of this Act, providing for the
  6  1 elimination of a provision prohibiting the sale of
  6  2 methyl tertiary butyl ether."
  6  3    #30.  Page 19, by inserting after line 12, the
  6  4 following:
  6  5    "   .  Section 301 relating to supporting the
  6  6 department of agriculture and land stewardship's
  6  7 administrative division."
  6  8    #31.  Title page, line 1, by striking the word
