  1  1    Amend House File 2419 as passed by the House as
  1  2 follows:
  1  3    #1.  Page 3, by inserting after line 15 the
  1  4 following:
  1  5    "Sec. ___.  NEW SECTION.  124.414  DRUG
  1  6 PARAPHERNALIA.
  1  7    1.  a.  As used in this section, "drug
  1  8 paraphernalia" means all equipment, products, or
  1  9 materials of any kind used or attempted to be used in
  1 10 combination with a controlled substance, except those
  1 11 items used in combination with the lawful use of a
  1 12 controlled substance, to knowingly or intentionally
  1 13 and primarily do any of the following:
  1 14    (1)  Manufacture a controlled substance.
  1 15    (2)  Inject, ingest, inhale, or otherwise introduce
  1 16 into the human body a controlled substance.
  1 17    (3)  Test the strength, effectiveness, or purity of
  1 18 a controlled substance.
  1 19    (4)  Enhance the effect of a controlled substance.
  1 20    b.  "Drug paraphernalia" does not include
  1 21 hypodermic needles or syringes if manufactured,
  1 22 delivered, sold, or possessed for a lawful purpose.
  1 23    2.  It is unlawful for any person to knowingly or
  1 24 intentionally manufacture, deliver, sell, or possess
  1 25 drug paraphernalia.
  1 26    3.  This section shall not be construed to preempt
  1 27 the adoption or enforcement of a drug paraphernalia
  1 28 ordinance by a local authority as defined in section
  1 29 321.1.
  1 30    4.  A person who violates this section commits a
  1 31 simple misdemeanor."
  1 32    #2.  Title page, by striking lines 1 and 2 and
  1 33 inserting the following:  "An Act concerning the
  1 34 criminal penalties relating to amphetamines or drug
  1 35 paraphernalia."
