PAG LIN 1 1 Amend House File 2511, as passed by the House, as 1 2 follows: 1 3 #1. By striking everything after the enacting 1 4 clause and inserting the following: 1 5 "Section 1. Section 321J.22, subsections 2, 4, and 1 6 5, Code 1999, are amended to read as follows: 1 7 2. a. The course provided according to this 1 8 section shall be offered on a regular basis at each 1 9 community college as defined in section 260C.2, or by 1 10 substance abuse treatment programs licensed under 1 11 chapter 125. However, a community college shall not 1 12 be required to offer the course if a substance abuse 1 13 treatment program licensed under chapter 125 offers 1 14 the course within the merged area served by the 1 15 community college. 1 16 b. Enrollment in the courses is not limited to 1 17 persons ordered to enroll, attend, and successfully 1 18 complete the course required under sections 321J.2 and 1 19 321J.17, subsection 2. However, any person under age 1 20 eighteen who is required to attend the courses for 1 21 violation of section 321J.2 or 321J.17 must attend a 1 22 course offered by a substance abuse treatment program 1 23 licensed under chapter 125. 1 24 c. The course required by this section shall be: 1 25taught1 26 (1) Taught bythea communitycollegescollege 1 27 under the supervision of the department of education 1 28and approvedor by a substance abuse treatment program 1 29 licensed under chapter 125. 1 30 (2) Approved by the department of education, in 1 31 consultation with the community colleges and substance 1 32 abuse treatment programs licensed under chapter 125. 1 33 d. The department of education shall establish 1 34 reasonable fees to defray the expense of obtaining 1 35 classroom space, instructor salaries, and class 1 36 materials for courses offered both by community 1 37 colleges and by substance abuse treatment programs 1 38 licensed under chapter 125. 1 39 e. A person shall not be denied enrollment in a 1 40 course by reason of the person's indigency. 1 41 4. The department of education and substance abuse 1 42 treatment programs licensed under chapter 125 shall 1 43 prepare for their respective courses a list of the 1 44 locations of the courses taught under this section, 1 45 the dates and times taught, the procedure for 1 46 enrollment, and the schedule of course fees. The list 1 47 shall be kept current and a copy of the list shall be 1 48 sent to each court having jurisdiction over offenses 1 49 provided in this chapter. 1 50 5. The department of education and substance abuse 2 1 treatment programs licensed under chapter 125 shall 2 2 maintain enrollment, attendance, successful and 2 3 nonsuccessful completion data for their respective 2 4 courses on the persons ordered to enroll, attend, and 2 5 successfully complete a course for drinking drivers. 2 6 This data shall be forwarded to the court by both the 2 7 department of education and substance abuse treatment 2 8 programs licensed under chapter 125." 2 9 #2.
