1 1 Amend Senate File 2395 as follows:
1 2 #1. Page 13, by striking lines 10 through 16 and
1 3 inserting the following: "state, or local. Except as
1 4 provided in this section, IowAccess shall be a state
1 5 funded service providing access, including enhanced
1 6 access, to government information and transactions.
1 7 The information technology council, in establishing
1 8 the fees for enhanced access, shall consider the
1 9 reasonable cost of accessing such government
1 10 information through IowAccess. A fee for enhanced
1 11 access shall not exceed the direct cost of accessing
1 12 government information and transactions, and shall be
1 13 set in accordance with section 22.3A, subsection 2,
1 14 paragraph "b".
1 15 For purposes of this section, "enhanced access"
1 16 means access to government information which is not
1 17 currently available to the public and which requires
1 18 special sorts or formatting, or other action to
1 19 provide such information, access to government
1 20 information which is responsive to special requests
1 21 for multiple government records in customized formats,
1 22 or routine batch processing requests for information
1 23 databases that would permit a recipient to obtain and
1 24 commercially market available government information.
1 25 A fee shall not be charged for government
1 26 information or access to government information on or
1 27 after the effective date of this section if a fee is
1 28 not charged for such information or access to such
1 29 information prior to that date.
1 30 This section shall not be construed to impair the
1 31 right of a person to contract to purchase information
1 32 or data from the Iowa court information system or any
1 33 other governmental entity. This section shall not be
1 34 construed to affect a data purchase agreement or
1 35 contract in existence on the effective date of this
1 36 section."
