1 3 #1. Page 1, by inserting before line 1 the
1 4 following:
1 5 "Section 1. Section 257.6, subsection 3, Code
1 6 1999, is amended by adding the following new
1 7 unnumbered paragraph:
1 8 NEW UNNUMBERED PARAGRAPH. For the purposes of
1 9 calculating special education support services costs
1 10 for the school budget year beginning July 1, 2001, and
1 11 succeeding budget years, a school district shall
1 12 include accredited nonpublic school pupils receiving
1 13 special education support services in determining its
1 14 additional enrollment because of special education
1 15 pursuant to this subsection. If, however, a nonpublic
1 16 school pupil or a pupil attending another district
1 17 under a whole grade sharing agreement or open
1 18 enrollment receives special education support services
1 19 through an area education agency other than the area
1 20 education agency of the pupil's residence, the pupil
1 21 shall be deemed to be served by the area education
1 22 agency of the pupil's residence, which shall by
1 23 contractual arrangement reimburse the area education
1 24 agency through which the pupil actually receives
1 25 services. Each school district shall include in the
1 26 December 15 additional enrollment certification for
1 27 special education the number of nonpublic school
1 28 pupils within the school district receiving special
1 29 education support services by the area education
1 30 agency. If an area education agency does not provide
1 31 by itself or through another area education agency
1 32 special education support services to nonpublic school
1 33 pupils in a manner comparable to services provided
1 34 public school pupils, as determined by the state board
1 35 of education, the state board shall instruct the
1 36 department of management to reduce the special
1 37 education support services budget one time by an
1 38 amount to compensate for such reduced services. The
1 39 special education support services budget shall be
1 40 reduced by an amount equal to the product of the cost
1 41 per pupil in basic enrollment for the budget year for
1 42 special education support services times the
1 43 difference between the enrollment served and the basic
1 44 enrollment recorded for the area.
1 45 Sec. . Section 257.6, subsection 5, unnumbered
1 46 paragraph 2, Code 1999, is amended to read as follows:
1 47 Weighted enrollment for special education support
1 48 services costs is equal to the weighted enrollment as
1 49 calculated pursuant to subsection 3, minus the
1 50 additional pupils added due to the application of the
2 1 supplementary weighting.
2 2 Sec. . Section 257.9, subsections 3 and 4, Code
2 3 1999, are amended by striking the subsections and
2 4 inserting in lieu thereof the following:
2 5 3. SPECIAL EDUCATION SUPPORT SERVICES STATE COST
2 6 PER PUPIL FOR 2001-2002. For the budget year
2 7 beginning July 1, 2001, for the special education
2 8 support services state cost per pupil, the department
2 9 of management shall divide the total of the approved
2 10 budgets of the area education agencies for special
2 11 education support services for that year which are
2 12 approved by the state board of education under section
2 13 273.3, subsection 12, by the total of the weighted
2 14 enrollment for special education support services in
2 15 the state for the budget year. The special education
2 16 support services state cost per pupil for the budget
2 17 year is the amount calculated by the department of
2 18 management under this subsection.
2 19 4. SPECIAL EDUCATION SUPPORT SERVICES STATE COST
2 20 PER PUPIL FOR 2002-2003 AND SUCCEEDING YEARS. For the
2 21 budget year beginning July 1, 2002, and succeeding
2 22 budget years, the special education support services
2 23 state cost per pupil for the budget year is the
2 24 special education support services state cost per
2 25 pupil for the base year plus the special education
2 26 support services allowable growth for the budget year.
2 27 Sec. . Section 257.10, subsections 3 and 4,
2 28 Code Supplement 1999, are amended by striking the
2 29 subsections and inserting in lieu thereof the
2 30 following:
2 31 3. SPECIAL EDUCATION SUPPORT SERVICES DISTRICT
2 32 COST PER PUPIL FOR 2001-2002. For the budget year
2 33 beginning July 1, 2001, for the special education
2 34 support services district cost per pupil, the
2 35 department of management shall divide the approved
2 36 budget of each area education agency for special
2 37 education support services for that year approved by
2 38 the state board of education, under section 273.3,
2 39 subsection 12, by the total of the weighted enrollment
2 40 for special education support services in the area for
2 41 that budget year.
2 42 The special education support services district
2 43 cost per pupil for each school district in an area for
2 44 the budget year is the amount calculated by the
2 45 department of management under this subsection. If,
2 46 however, the special education support services
2 47 district cost per pupil calculated under this
2 48 subsection in any school district is less than the
2 49 special education support services state cost per
2 50 pupil for the budget year, the department of
3 1 management shall increase the special education
3 2 support services district cost per pupil of that
3 3 district to an amount equal to the special education
3 4 support services state cost per pupil for the budget
3 5 year.
3 6 4. SPECIAL EDUCATION SUPPORT SERVICES DISTRICT
3 7 COST PER PUPIL FOR 2002-2003 AND SUCCEEDING YEARS.
3 8 For the budget year beginning July 1, 2002, and
3 9 succeeding budget years, the special education support
3 10 services district cost per pupil for the budget year
3 11 is the special education support services district
3 12 cost per pupil for the base year plus the special
3 13 education support services allowable growth for the
3 14 budget year."
3 15 #2. Page 1, by striking lines 18 and 19 and
3 16 inserting the following:
3 17 "Sec. . EFFECTIVE AND APPLICABILITY DATES.
3 18 1. The section of this Act amending section 257.6,
3 19 subsection 3, is applicable for the purposes of
3 20 determining weighted enrollment and special education
3 21 support services state and district cost calculations
3 22 for the school budget year beginning July 1, 2001, and
3 23 succeeding budget years.
3 24 2. The section of this Act amending section
3 25 257.46, being deemed of immediate importance, takes
3 26 effect upon enactment."
3 27 #3. Title page, by striking lines 2 and 3 and
3 28 inserting the following: "determining gifted and
3 29 talented program funding, providing for the
3 30 utilization of an enrollment count including nonpublic
3 31 school pupils in determining special education support
3 32 services funding, and providing effective and
3 33 applicability dates."
