  1  1    Amend Senate File 2411 as follows:
  1  2    #1.  Page 21, by inserting after line 18 the
  1  3 following:
  1  4    "Sec. ___.  Section 97B.49B, subsection 1,
  1  5 paragraph a, Code 1999, is amended to read as follows:
  1  6    a.  "Applicable percentage" means the greater of
  1  7 the following percentages:
  1  8    (1)  sixty Sixty percent or, for.
  1  9    (2)  For each active or inactive vested member
  1 10 retiring on or after July 1, 1996, but before July 1,
  1 11 2000, sixty percent plus, if applicable, an additional
  1 12 one-fourth of one percentage point for each additional
  1 13 calendar quarter of eligible service beyond twenty-
  1 14 five years of service for the member, not to exceed a
  1 15 total of five additional percentage points.
  1 16    (3)  For each active or inactive vested member
  1 17 retiring on or after July 1, 2000, but before July 1,
  1 18 2001, sixty percent plus, if applicable, an additional
  1 19 one-fourth of one percentage point for each additional
  1 20 calendar quarter of eligible service beyond twenty-
  1 21 four years of service for the member, not to exceed a
  1 22 total of six additional percentage points.
  1 23    (4)  For each active or inactive vested member
  1 24 retiring on or after July 1, 2001, but before July 1,
  1 25 2002, sixty percent plus, if applicable, an additional
  1 26 one-fourth of one percentage point for each additional
  1 27 calendar quarter of eligible service beyond twenty-
  1 28 three years of service for the member, not to exceed a
  1 29 total of seven additional percentage points.
  1 30    (5)  For each active or inactive vested member
  1 31 retiring on or after July 1, 2002, but before July 1,
  1 32 2003, sixty percent plus, if applicable, an additional
  1 33 one-fourth of one percentage point for each additional
  1 34 calendar quarter of eligible service beyond twenty-two
  1 35 years of service for the member, not to exceed a total
  1 36 of eight additional percentage points.
  1 37    (6)  For each active or inactive vested member
  1 38 retiring on or after July 1, 2003, sixty percent plus,
  1 39 if applicable, an additional three-eighths of one
  1 40 percentage point for each additional calendar quarter
  1 41 of eligible service beyond twenty-two years of service
  1 42 for the member, not to exceed a total of twelve
  1 43 additional percentage points.
  1 44    Sec.    .  Section 97B.49B, subsection 1, Code
  1 45 1999, is amended by adding the following new
  1 46 paragraph:
  1 47    NEW PARAGRAPH.  aa.  "Applicable years of service"
  1 48 means the following:
  1 49    (1)  For each active or inactive vested member
  1 50 retiring on or after July 1, 1996, and before July 1,
  2  1 2000, twenty-five.
  2  2    (2)  For each active or inactive vested member
  2  3 retiring on or after July 1, 2000, and before July 1,
  2  4 2001, twenty-four.
  2  5    (3)  For each active or inactive vested member
  2  6 retiring on or after July 1, 2001, and before July 1,
  2  7 2002, twenty-three.
  2  8    (4)  For each active or inactive vested member
  2  9 retiring on or after July 1, 2002, twenty-two.
  2 10    Sec.    .  Section 97B.49B, subsection 1, paragraph
  2 11 c, Code 1999, is amended to read as follows:
  2 12    c.  "Fraction of years of service" means a number,
  2 13 not to exceed one, equal to the sum of the years of
  2 14 eligible service in a protection occupation divided by
  2 15 twenty-five the applicable years of service for the
  2 16 member."
  2 17    #2.  Page 21, by inserting after line 24 the
  2 18 following:
  2 19    "Sec.    .  Section 97B.49D, subsection 1,
  2 20 paragraph b, Code 1999, is amended to read as follows:
  2 21    b.  One-twelfth of an amount equal to the
  2 22 applicable percentage of the member's three-year
  2 23 average covered wage multiplied by a fraction of years
  2 24 of service.  The fraction of years of service for
  2 25 purposes of this paragraph shall be the actual years
  2 26 of service, not to exceed twenty-five the applicable
  2 27 years of service for the member as defined in section
  2 28 97B.49B, earned in a position described in section
  2 29 97B.49B, for which special service contributions were
  2 30 made, divided by twenty-five the applicable years of
  2 31 service for the member as defined in section 97B.49B.
  2 32 In calculating the fractions of years of service under
  2 33 the paragraph, a member shall not receive special
  2 34 service credit for years of service for which the
  2 35 member and the member's employer did not make the
  2 36 required special service contributions to the
  2 37 department."
  2 38    #3.  Page 39, line 9, by striking the word "twenty-
  2 39 five" and inserting the following:  "twenty-five the
  2 40 applicable years of service for the member as defined
  2 41 in section 97B.49B if the member had retired on the
  2 42 date of death".
