1 1 Amend Senate File 2314 as follows:
1 2 #1. Page 4, by striking lines 18 through 24.
1 3 #2. Page 16, by striking lines 25 through 33, and
1 4 inserting the following:
1 5 "2. Notwithstanding subsection 1, an individual
1 6 who repeatedly fails to file any mandatory report
1 7 specified in this chapter is subject to a report being
1 8 made to the licensing board governing the professional
1 9 activities of the individual. The department shall
1 10 notify the individual each time that the department
1 11 determines that the individual has failed to file a
1 12 required report. The department shall inform the
1 13 individual in the notification that the individual may
1 14 provide information to the department to explain or
1 15 dispute the failure to report.
1 16 3. Notwithstanding subsection 1, a public, private
1 17 or hospital clinical laboratory that repeatedly fails
1 18 to file a mandatory report specified in this chapter
1 19 is subject to a civil penalty of not more than one
1 20 thousand dollars per occurrence. The department shall
1 21 not impose the penalty under this subsection without
1 22 prior written notice and opportunity for hearing."
1 23 #3. Page 21, by striking line 7, and inserting the
1 24 following:
1 25 "A person who knowingly makes a false statement in
1 26 any of the reports required by".
1 27 #4. Page 21, line 24, by striking the word
1 28 "subsection" and inserting the following:
1 29 "subsections".
1 30 #5. Page 21, by striking lines 25 through 31, and
1 31 inserting the following:
1 32 "NEW SUBSECTION. 7. An individual who repeatedly
1 33 fails to file the report required under this section
1 34 is subject to a report being made to the licensing
1 35 board governing the professional activities of the
1 36 individual. The department shall notify the
1 37 individual each time the department determines that
1 38 the individual has failed to file a required report.
1 39 The department shall inform the individual in the
1 40 notification that the individual may provide
1 41 information to the department to explain or dispute
1 42 the failure to report.
1 43 NEW SUBSECTION. 8. A public, private or hospital
1 44 clinical laboratory that repeatedly fails to make the
1 45 report required under this section is subject to a
1 46 civil penalty of not more than one thousand dollars
1 47 per occurrence. The department shall not impose the
1 48 penalty under this subsection without prior written
1 49 notice and opportunity for hearing."
1 50 #6. By renumbering as necessary.
