PAG LIN 1 1 Amend Senate File 2245 as follows: 1 2 #1. Page 5, by striking lines 20 through 35 and 1 3 inserting the following: "shall be chargeable, where 1 4 the fine charged does not exceed onehundredthousand 1 5 dollars, only by uniform citation and complaint. 1 6 Violations of the schedule of weight violations, where 1 7 the fine charged exceeds onehundredthousand dollars 1 8 shall, when the violation is admitted and section 1 9 805.9 applies, be chargeable upon uniform citation and 1 10 complaint, indictment, or county attorney's 1 11 information, but otherwise, shall be chargeable only 1 12 upon indictment or county attorney's information. 1 13 In all cases of charges under the schedule of 1 14 weight violations, the charge shall specify the amount 1 15 of fine charged under the schedule. Where a defendant 1 16 is convicted and the fine under the foregoing schedule 1 17 of weight violations exceeds onehundredthousand 1 18 dollars, the conviction shall be of an indictable 1 19 offense although section 805.9 is employed and whether 1 20 the violation is charged upon uniform citation and 1 21 complaint, indictment, or county attorney's 1 22 information." 1 23 #2.
