1 1 Amend the House amendment, S-3513, to Senate File
1 2 459, as amended, passed, and reprinted by the Senate,
1 3 as follows:
1 4 #1. Page 3, by inserting after line 24 the
1 5 following:
1 6 "Sec. . NEW SECTION. 257.14A ON-TIME FUNDING
1 7 FOR SPECIAL EDUCATION.
1 8 Commencing with the budget year beginning July 1,
1 9 2000, if a school district's additional enrollment
1 10 because of special education determined by the
1 11 district on December 1 in the budget year is greater
1 12 than its additional enrollment because of special
1 13 education determined by the district on December 1 in
1 14 the base year, the school district is entitled to on-
1 15 time funding from the state in an amount equal to its
1 16 district cost per pupil for the budget year multiplied
1 17 by the district's increase in additional enrollment
1 18 because of special education. The additional funding
1 19 shall be miscellaneous income.
1 20 For the purpose of this section, a school
1 21 district's additional enrollment because of special
1 22 education is determined by multiplying the weighting
1 23 for each category of child under section 256B.9 times
1 24 the number of children in each category totaled for
1 25 all categories minus the total number of children in
1 26 all categories.
1 27 If a district receives additional funding under
1 28 this section for a budget year, the department of
1 29 management shall determine the amount of the
1 30 additional funding which would have been generated by
1 31 local property tax revenues in proportion to the
1 32 amount of funding actually received pursuant to this
1 33 section, if the additional enrollment because of
1 34 special education in the budget year had been used for
1 35 that budget year in determining combined district
1 36 cost, shall reduce, but not by more than the amount of
1 37 the additional funding, the district's total state
1 38 school aids available under this chapter for the next
1 39 following budget year by the amount so determined, and
1 40 shall increase the district's additional property tax
1 41 levy for the next following budget year by the amount
1 42 necessary to compensate for the reduction in state
1 43 aid, so that the local property tax for the next
1 44 following year will be increased only by the amount
1 45 which would have been increased in the budget year if
1 46 the additional enrollment because of special education
1 47 in the budget year could have been used to establish
1 48 the levy.
1 49 There is appropriated for the fiscal year beginning
1 50 July 1, 2000, and each succeeding fiscal year, from
2 1 the general fund of the state to the department of
2 2 education, the amount required to pay on-time funding
2 3 authorized under this section, up to a maximum of
2 4 thirteen million dollars annually, which shall be paid
2 5 to school districts in the same manner as other state
2 6 aids are paid under section 257.16. If the amount
2 7 appropriated is insufficient to provide the full
2 8 amount of on-time funding, the payments to school
2 9 districts shall be prorated such that each school
2 10 district shall receive an amount of on-time funding
2 11 equal to the percentage that the on-time funding to be
2 12 provided to the school district bears to the total
2 13 amount of on-time funding to be provided to all school
2 14 districts."
