1 3 #1. Page 1, by inserting before line 1 the
1 4 following:
1 5 "Section 1. NEW SECTION. 328.36A STATE AVIATION
1 6 FUND.
1 7 There is created a fund to be known as the state
1 8 aviation fund, which shall consist of all moneys
1 9 received by the department from the use tax collected
1 10 on aircraft subject to registration as provided in
1 11 section 423.7B, together with all moneys appropriated
1 12 to the fund by the state.
1 13 Unless otherwise provided, the fund is appropriated
1 14 for airport engineering studies and construction of or
1 15 improvements to public airports.
1 16 Notwithstanding section 12C.7, subsection 2,
1 17 interest or earnings on investments or time deposits
1 18 of the moneys in the state aviation fund shall be
1 19 credited to the state aviation fund."

1 21 following:
1 22 "Sec. . NEW SECTION. 423.7B AIRCRAFT SUBJECT
1 23 TO REGISTRATION.
1 24 The tax imposed upon the use of aircraft subject to
1 25 registration shall be paid by the owner of the
1 26 aircraft to the state department of transportation
1 27 from whom the registration receipt is obtained. A
1 28 registration receipt for an aircraft subject to
1 29 registration shall not be issued until the tax has
1 30 been paid. The state department of transportation
1 31 shall require every applicant for a registration
1 32 receipt for an aircraft subject to registration to
1 33 supply information as the director deems necessary as
1 34 to the time of purchase, the purchase price, and other
1 35 information relative to the purchase of the aircraft.
1 36 On or before the tenth day of each month the state
1 37 department of transportation shall remit to the
1 38 department the amount of the taxes collected during
1 39 the preceding month.
1 40 Sec. . Section 423.24, Code 1999, is amended by
1 41 adding the following new subsection:
1 42 NEW SUBSECTION. 2A. All revenues derived from the
1 43 use tax on aircraft subject to registration as
1 44 collected pursuant to section 423.7B shall be
1 45 deposited and credited to the state aviation fund
1 46 created in section 328.36A."
