  1  1    Amend Senate File 414 as follows:
  1  2    #1.  Page 1, by inserting after line 18 the
  1  3 following:
  1  4    "Sec.    .  Section 730.5, subsection 9, paragraph
  1  5 g, Code 1999, is amended by adding the following new
  1  6 subparagraph:
  1  7    NEW SUBPARAGRAPH.  (4)  However, unless the
  1  8 employee establishes by a preponderance of the
  1  9 evidence that the violation of the employer's
  1 10 substance abuse policy occurred while at the work
  1 11 site, subparagraphs (1) through (3) shall not apply
  1 12 and the employee shall be responsible for the costs of
  1 13 rehabilitation."
  1 14    #2.  By renumbering as necessary.
