  1  1    Amend Senate File 211 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 249A.3, subsection 2, Code
  1  5 1999, is amended by adding the following new lettered
  1  6 paragraph before paragraph a and renumbering the
  1  7 subsequent paragraphs:
  1  8    NEW PARAGRAPH.  a.  As allowed under 42 U.S.C. }
  1  9 1396a(a)(10)(A)(ii)(XIII), individuals with
  1 10 disabilities, who are less than sixty-five years of
  1 11 age, who are members of families whose income is less
  1 12 than two hundred fifty percent of the most recently
  1 13 revised official poverty line published by the federal
  1 14 office of management and budget for the family, who
  1 15 have earned income and who are eligible for medical
  1 16 assistance or additional medical assistance under this
  1 17 section if earnings are disregarded.  As allowed by 42
  1 18 U.S.C. } 1396a(r)(2), unearned income shall also be
  1 19 disregarded in determining whether an individual is
  1 20 eligible for assistance under this paragraph.  For the
  1 21 purposes of determining the amount of an individual's
  1 22 resources under this paragraph and as allowed by 42
  1 23 U.S.C. } 1396a(r)(2), a maximum of ten thousand
  1 24 dollars of available resources shall be disregarded
  1 25 and any additional resources held in a retirement
  1 26 account, in a medical savings account, or in any other
  1 27 account approved under rules adopted by the department
  1 28 shall also be disregarded.  Individuals eligible for
  1 29 assistance under this paragraph, whose individual
  1 30 income exceeds one hundred fifty percent of the
  1 31 official poverty line published by the federal office
  1 32 of management and budget for an individual, shall pay
  1 33 a premium.  The amount of the premium shall be based
  1 34 on a sliding fee schedule adopted by rule of the
  1 35 department and shall be based on a percentage of the
  1 36 individual's income.  The maximum premium payable by
  1 37 an individual whose income exceeds one hundred fifty
  1 38 percent of the official poverty line shall be
  1 39 commensurate with premiums charged for private group
  1 40 health insurance in this state.  This paragraph shall
  1 41 be implemented no later than March 1, 2000."
  1 42    #2.  Title page, line 1, by striking the words
  1 43 "disabled persons" and inserting the following:
  1 44 "persons with disabilities".
