PAG LIN 1 1 Amend Senate File 449 as follows: 1 2 #1. Page 2, by inserting after line 26 the 1 3 following: 1 4 "Sec. 100. Sections 101 through 111 of this Act 1 5 are enacted as subchapter 11 of chapter 216A. 1 6 Sec. 101. NEW SECTION. 216A.151 DEFINITIONS. 1 7 For purposes of this subchapter, unless the context 1 8 otherwise requires: 1 9 1. "Administrator" means the administrator of the 1 10 division on the status of Iowans of Asian and Pacific 1 11 Islander heritage of the department of human rights. 1 12 2. "Asian and Pacific Islander" means a person 1 13 from any of the countries of Asia or islands of the 1 14 Pacific. 1 15 3. "Commission" means the commission on the status 1 16 of Iowans of Asian and Pacific Islander heritage. 1 17 4. "Division" means the division on the status of 1 18 Iowans of Asian and Pacific Islander heritage of the 1 19 department of human rights. 1 20 Sec. 102. NEW SECTION. 216A.152 ESTABLISHMENT. 1 21 A commission on the status of Iowans of Asian and 1 22 Pacific Islander heritage is established consisting of 1 23 nine members appointed by the governor. The members 1 24 of the commission shall appoint one of the members to 1 25 serve as chairperson of the commission. 1 26 Sec. 103. NEW SECTION. 216A.153 TERM OF OFFICE. 1 27 Four of the members appointed to the initial 1 28 commission shall be designated by the governor to 1 29 serve two-year terms, and five shall be designated by 1 30 the governor to serve four-year terms. Succeeding 1 31 appointments shall be for a term of four years. 1 32 Vacancies in the membership shall be filled for the 1 33 unexpired term in the same manner as the original 1 34 appointment. 1 35 Sec. 104. NEW SECTION. 216A.154 MEETINGS OF THE 1 36 COMMISSION. 1 37 The commission shall meet at least four times each 1 38 year, and shall hold special meetings on the call of 1 39 the chairperson. The commission shall adopt rules 1 40 pursuant to chapter 17A as it deems necessary for the 1 41 commission and division. The members of the 1 42 commission shall be reimbursed for actual expenses 1 43 while engaged in their official duties. A member may 1 44 also be eligible to receive compensation as provided 1 45 in section 7E.6. 1 46 Sec. 105. NEW SECTION. 216A.155 DUTIES. 1 47 The commission shall: 1 48 1. Advise the governor and the general assembly on 1 49 issues confronting Asian and Pacific Islander persons 1 50 in this state, including the unique problems of non- 2 1 English-speaking immigrants and refugees. 2 2 2. Advise the governor and the general assembly of 2 3 administrative and legislative changes necessary to 2 4 ensure Asian and Pacific Islander persons access to 2 5 benefits and services provided to people in this 2 6 state. 2 7 3. Recommend to the governor and the general 2 8 assembly any revisions in the state's affirmative 2 9 action program and other steps necessary to eliminate 2 10 underutilization of Asian and Pacific Islander persons 2 11 in the state's workforce. 2 12 4. Recommend to the governor and the general 2 13 assembly legislation designed to improve the economic 2 14 and social condition of Asian and Pacific Islander 2 15 persons in this state. 2 16 5. Serve as a conduit to state government for 2 17 organizations of Asian and Pacific Islander persons in 2 18 this state. 2 19 6. Serve as a referral agency to assist Asian and 2 20 Pacific Islander persons in securing access to state 2 21 agencies and programs. 2 22 7. Serve as a liaison with the federal government, 2 23 local government units, and private organizations on 2 24 matters relating to the Asian and Pacific Islander 2 25 persons of this state. 2 26 8. Perform or contract for the performance of 2 27 studies designed to suggest solutions to the problems 2 28 of Asian and Pacific Islander persons in the areas of 2 29 education, employment, human rights, health, housing, 2 30 social welfare, and other related areas. 2 31 9. Implement programs designed to solve the 2 32 problems of Asian and Pacific Islander persons when 2 33 authorized by law. 2 34 10. Publicize the accomplishments of Asian and 2 35 Pacific Islander persons and their contributions to 2 36 this state. 2 37 11. Work with other state and federal agencies and 2 38 organizations to develop small business opportunities 2 39 and promote economic development for Asian and Pacific 2 40 Islander persons. 2 41 12. Supervise development of an Asian and Pacific 2 42 Islander trade primer, outlining Asian and Pacific 2 43 Islander customs, cultural traditions, and business 2 44 practices, including language usage for use by Iowa's 2 45 export community. 2 46 13. Cooperate with other state and federal 2 47 agencies and organizations to develop improved state 2 48 trade relations with Asian and Pacific Islander 2 49 countries. 2 50 Sec. 106. NEW SECTION. 216A.156 REVIEW OF GRANT 3 1 APPLICATIONS AND BUDGET REQUESTS. 3 2 Before the submission of an application, state 3 3 departments and agencies shall consult with the 3 4 commission concerning applications for federal funding 3 5 that will have its primary effect on Asian and Pacific 3 6 Islander persons in Iowa. The commission shall advise 3 7 the governor and the director of revenue and finance 3 8 concerning any state agency request that will have its 3 9 primary effect on Asian and Pacific Islander persons 3 10 in Iowa. 3 11 Sec. 107. NEW SECTION. 216A.157 ADDITIONAL 3 12 AUTHORITY. 3 13 The commission may: 3 14 1. Enter into contracts, within the limit of funds 3 15 made available to it, with individuals, organizations, 3 16 and institutions for services. 3 17 2. Solicit and accept grants of moneys or property 3 18 from the federal government or any other source, and 3 19 may upon its own order use this money, property, or 3 20 other resources to accomplish the duties of the 3 21 commission. 3 22 Sec. 108. NEW SECTION. 216A.158 EMPLOYEES AND 3 23 RESPONSIBILITY. 3 24 The commission shall employ necessary employees. 3 25 Pursuant to section 216A.2, the commission shall have 3 26 responsibility for budgetary and personnel decisions 3 27 for the commission and division. The administrator 3 28 shall administer programs and policies as determined 3 29 by the commission. 3 30 Sec. 109. NEW SECTION. 216A.159 STATE AGENCY 3 31 ASSISTANCE. 3 32 On the request of the commission, state departments 3 33 and agencies shall supply the commission with advisory 3 34 staff services on matters relating to the jurisdiction 3 35 of the commission. The commission shall cooperate and 3 36 coordinate its activities with other state agencies to 3 37 the highest possible degree. 3 38 Sec. 110. NEW SECTION. 216A.160 ANNUAL REPORT. 3 39 Not later than February 1 of each year the 3 40 commission shall file a report with the governor and 3 41 the general assembly of its proceedings for the 3 42 previous calendar year, and may submit with the report 3 43 such recommendations pertaining to its affairs as the 3 44 commission deems desirous, including recommendations 3 45 for legislative consideration and other action it 3 46 deems necessary. 3 47 Sec. 111. Section 216A.1, Code 1999, is amended by 3 48 adding the following new subsection: 3 49 NEW SUBSECTION. 8. Division on the status of 3 50 Iowans of Asian and Pacific Islander heritage." 4 1 #2.
