1 1 Section 1. Section 422.45, Code supplement 1999, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 57. The gross receipts from the sale or
1 4 rental of information or data reports or from the performing,
1 5 rendering, or furnishing of information services, including
1 6 data processing services, when the information or data reports
1 7 or information services are transferred by storage media or by
1 8 electronic means, utilizing cable, radio waves, microwaves,
1 9 satellites, fiber optics, or by similar methods using
1 10 electromagnetic waves for purposes of being recorded on
1 11 storage media. The exemption for the sale or rental of
1 12 information or data reports includes, but is not limited to,
1 13 database files, mailing and subscription lists, market
1 14 research, credit reports, and surveys.
1 15 For purposes of this subsection, "storage media" includes
1 16 hard disks, compact disks, floppy disks, diskettes, diskpacks,
1 17 magnetic tape, cards, paper tape, paper, mailing labels,
1 18 books, film, video tape, audio tape, cassette, coding sheets,
1 19 records, drums, microfilm, or other media or devices used for
1 20 storage of information.
1 21 Sec. 2. REFUNDS. Refunds of taxes, interest, or penalties
1 22 which arise from claims resulting from the enactment of
1 23 section 422.45, subsection 57, in this Act, for sales,
1 24 rentals, or services occurring between March 15, 1995, and the
1 25 effective date of this Act, shall be limited to twenty-five
1 26 thousand dollars in the aggregate and shall not be allowed
1 27 unless refund claims are filed prior to October 1, 2000,
1 28 notwithstanding any other provision of law. If the amount of
1 29 claims totals more than twenty-five thousand dollars in the
1 30 aggregate, the department of revenue and finance shall prorate
1 31 the twenty-five thousand dollars among all claimants in
1 32 relation to the amounts of the claimants' valid claims.
1 33 Sec. 3. EFFECTIVE DATE AND RETROACTIVE APPLICABILITY
1 34 PROVISION. This Act, being deemed of immediate importance,
1 35 takes effect upon enactment and applies retroactively to March
2 1 15, 1995.
2 2 EXPLANATION
2 3 This bill exempts from the sales and use taxes the sale or
2 4 rental of information and data reports and the furnishing of
2 5 information or data services when these are transferred by
2 6 storage media or by electromagnetic waves, satellites, fiber
2 7 optics, or cable for purposes of being recorded on storage
2 8 media. Storage media includes disks, videotape, magnetic
2 9 tape, cards, paper tapes, audio tapes, and microfilm. The
2 10 exemption for the sale or rental of information or data
2 11 reports includes database files, mailing and subscription
2 12 lists, market research, credit reports, and surveys.
2 13 The bill takes effect upon enactment and applies
2 14 retroactively to March 15, 1995. Because of the retroactivity
2 15 of the exemption, refunds are authorized but are limited to
2 16 $25,000 in the aggregate.
