PAG LIN 1 1 Section 1. JUDICIAL BRANCH. There is appropriated from 1 2 the general fund of the state to the judicial branch for the 1 3 fiscal year beginning July 1, 2000, and ending June 30, 2001, 1 4 the following amounts, or so much thereof as is necessary, to 1 5 be used for the purposes designated: 1 6 1. For salaries of supreme court justices, appellate court 1 7 judges, district court judges, district associate judges, 1 8 judicial magistrates and staff, state court administrator, 1 9 clerk of the supreme court, district court administrators, 1 10 clerks of the district court, juvenile court officers, board 1 11 of law examiners and board of examiners of shorthand reporters 1 12 and judicial qualifications commission, receipt and 1 13 disbursement of child support payments, reimbursement of the 1 14 auditor of state for expenses incurred in completing audits of 1 15 the offices of the clerks of the district court during the 1 16 fiscal year beginning July 1, 2000, and maintenance, 1 17 equipment, and miscellaneous purposes: 1 18 .................................................. $109,008,259 1 19 a. The judicial branch, except for purposes of internal 1 20 processing, shall use the current state budget system, the 1 21 state payroll system, and the Iowa finance and accounting 1 22 system in administration of programs and payments for 1 23 services, and shall not duplicate the state payroll, 1 24 accounting, and budgeting systems. 1 25 b. The judicial branch shall submit monthly financial 1 26 statements to the legislative fiscal bureau and the department 1 27 of management containing all appropriated accounts in the same 1 28 manner as provided in the monthly financial status reports and 1 29 personal services usage reports of the department of revenue 1 30 and finance. The monthly financial statements shall include a 1 31 comparison of the dollars and percentage spent of budgeted 1 32 versus actual revenues and expenditures on a cumulative basis 1 33 for full-time equivalent positions and dollars. 1 34 c. The judicial branch shall continue to assist in the 1 35 development and implementation of a justice data warehouse 2 1 which shall include in the Iowa court information system, 2 2 starting with appointments of counsel made on or after July 1, 2 3 1999, the means to identify any case where the court has 2 4 determined indigence, and whether the case is handled by a 2 5 public defender or other court-appointed counsel. 2 6 d. Of the funds appropriated in this subsection, not more 2 7 than $1,897,728 may be transferred into the revolving fund 2 8 established pursuant to section 602.1302, subsection 3, to be 2 9 used for the payment of jury and witness fees and mileage. 2 10 e. The judicial branch shall focus efforts upon the 2 11 collection of delinquent fines, penalties, court costs, fees, 2 12 surcharges, or similar amounts. 2 13 f. It is the intent of the general assembly that the 2 14 offices of the clerks of the district court operate in all 2 15 ninety-nine counties and be accessible to the public as much 2 16 as is reasonably possible in order to address the relative 2 17 needs of the citizens of each county. 2 18 g. In addition to the requirements for transfers under 2 19 section 8.39, the judicial branch shall not change the 2 20 appropriations from the amounts appropriated to the branch in 2 21 this Act, unless notice of the revisions is given prior to 2 22 their effective date to the legislative fiscal bureau. The 2 23 notice shall include information on the branch's rationale for 2 24 making the changes and details concerning the work load and 2 25 performance measures upon which the changes are based. 2 26 h. The judicial branch shall provide to the cochairpersons 2 27 and ranking members of the joint appropriations subcommittee 2 28 on the justice system and to the legislative fiscal bureau by 2 29 January 15, 2001, an annual report concerning the operation 2 30 and use of the Iowa court information system and any 2 31 recommendations to improve the utilization of the system. The 2 32 annual report shall include information specifying the amounts 2 33 of fines, surcharges, and court costs collected using the 2 34 system and how the system is used to improve the collection 2 35 process. The report shall also include information concerning 3 1 efforts made by the judicial branch to facilitate the sharing 3 2 of vital sentencing and other information with other state 3 3 departments and governmental agencies involved in the criminal 3 4 justice system through the Iowa court information system. In 3 5 addition, the judicial branch shall submit a semiannual update 3 6 to the co-chairpersons and ranking members specifying the 3 7 amounts of fines, surcharges, and court costs collected using 3 8 the Iowa court information system since the last report. 3 9 i. The judicial branch shall provide a report to the 3 10 general assembly by January 1, 2001, concerning the amounts 3 11 received and expended from the enhanced court collections fund 3 12 created in section 602.1304 and the court technology and 3 13 modernization fund created in section 602.8108, subsection 4, 3 14 during the fiscal year beginning July 1, 1999, and ending June 3 15 30, 2000, and the plans for expenditures from each fund during 3 16 the fiscal year beginning July 1, 2000, and ending June 30, 3 17 2001. 3 18 j. The judicial branch shall continue to provide criminal 3 19 justice data to the department of corrections for use by the 3 20 Iowa corrections offender network (ICON) data system. 3 21 2. For the juvenile victim restitution program: 3 22 .................................................. $ 210,291 3 23 Sec. 2. JUDICIAL RETIREMENT FUND. There is appropriated 3 24 from the general fund of the state to the judicial retirement 3 25 fund for the fiscal year beginning July 1, 2000, and ending 3 26 June 30, 2001, the following amount, or so much thereof as is 3 27 necessary, to be used for the purpose designated: 3 28 For the state's contribution to the judicial retirement 3 29 fund established in section 602.9104, in the amount of 23.7 3 30 percent of the basic salaries of the judges covered under 3 31 chapter 602, article 9: 3 32 .................................................. $ 4,499,350 3 33 Sec. 3. INDIGENT DEFENSE COSTS. The supreme court shall 3 34 submit a written report for the preceding fiscal year no later 3 35 than January 1, 2001, indicating the amounts collected 4 1 pursuant to section 815.9A, relating to recovery of indigent 4 2 defense costs. The report shall include the total amount 4 3 collected by all courts, as well as the amounts collected by 4 4 each judicial district. The supreme court shall also submit a 4 5 written report quarterly indicating the number of criminal and 4 6 juvenile filings which occur in each judicial district for 4 7 purposes of estimating indigent defense costs. A copy of each 4 8 report shall be provided to the public defender, the 4 9 department of management, and the legislative fiscal bureau. 4 10 The judicial branch shall continue to assist in the 4 11 development of an automated data system for use in the sharing 4 12 of information utilizing the justice data warehouse for 4 13 legislative and executive branch uses. 4 14 Sec. 4. ENHANCED COURT COLLECTIONS FUND DISTRIBUTION. 4 15 Of the moneys collected and deposited in the enhanced court 4 16 collections fund created in section 602.1304 during the fiscal 4 17 year beginning July 1, 2000, $668,390 are appropriated to and 4 18 shall be expended by the judicial branch for the continued 4 19 implementation of the justice data warehouse. Of the moneys 4 20 appropriated in this section, $60,000 shall be transferred to 4 21 the division of criminal and juvenile justice planning of the 4 22 department of human rights for 1.00 FTE position to support 4 23 the justice data warehouse, and $608,390 shall be transferred 4 24 to the division of information technology services of the 4 25 department of general services for lease-purchase costs, and 4 26 other related expenses, concerning the justice data warehouse. 4 27 However, the moneys appropriated and transferred pursuant 4 28 to this section shall be reduced to the extent moneys are 4 29 appropriated for the purposes provided in this section to the 4 30 division of information technology services of the department 4 31 of general services or the division of criminal and juvenile 4 32 justice planning of the department of human rights from moneys 4 33 made available pursuant to section 8.62. 4 34 Sec. 5. Section 602.1301, subsection 2, Code 1999, is 4 35 amended to read as follows: 5 1 2. a. As early as possible, but not later than December 5 2 1, the supreme court shall submit to the legislative fiscal 5 3 bureau, and to the department of management, the annual budget 5 4 request and detailed supporting information for the judicial 5 5 branch. The submission shall be designed to assist the 5 6 legislative fiscal bureau in its preparation for legislative 5 7 consideration of the budget request. The information 5 8 submitted shall contain and be arranged in a format 5 9 substantially similar to the format specified by the director 5 10 of the department of management and used by all departments 5 11 and establishments in transmitting to the director estimates 5 12 of their expenditure requirements pursuant to section 8.23, 5 13 except the estimates of expenditure requirements shall be 5 14 based upon one hundred percent of funding for the current 5 15 fiscal year accounted for by program, and using the same line 5 16 item definitions of expenditures as used for the current 5 17 fiscal year's budget request, and the remainder of the 5 18 estimate of expenditure requirements prioritized by program. 5 19 The supreme court shall also make use of the department of 5 20 management's automated budget system when submitting 5 21 information to the director of the department of management to 5 22 assist the director in the transmittal of information as 5 23 required under section 8.35A. The supreme court shall budget 5 24 and track expenditures by the following separate organization 5 25 codes: 5 26 (1) Iowa court information system. 5 27 (2) Appellate courts. 5 28 (3) Central administration. 5 29 (4) District court administration. 5 30 (5) Judges and magistrates. 5 31 (6) Court reporters. 5 32 (7) Juvenile court officers. 5 33 (8) District court clerks. 5 34 (9) Jury and witness fees. 5 35 b. Before December 1, the supreme court shall submit to 6 1 the director of the department of management, and to the 6 2 chairpersons of the committees on appropriations, an estimate 6 3 of the total expenditure requirements of the judicial branch. 6 4 The director of the department of management shall submit this 6 5 estimate received from the supreme court to the governor for 6 6inclusion without changethe governor's consideration in 6 7 preparing the governor's proposed budget for the succeeding 6 8 fiscal year.The estimate shall also be submitted to the6 9chairpersons of the committees on appropriations.The governor 6 10 shall not be required to include the estimate without change 6 11 in the governor's proposed budget for the judicial branch but 6 12 may modify the estimate as determined by the governor. 6 13 EXPLANATION 6 14 This bill makes appropriations for the 2000-2001 fiscal 6 15 year to the judicial branch. 6 16 The bill provides that the judicial branch shall transfer 6 17 certain moneys in the enhanced court collections fund to the 6 18 division of criminal and juvenile justice planning of the 6 19 department of human rights and the division of information 6 20 technology services of the department of general services for 6 21 the continued development of the justice data warehouse. 6 22 The bill amends Code section 602.1301 to provide that the 6 23 governor may make changes to the budget request submitted by 6 24 the judicial branch to the governor in the governor's proposed 6 25 budget. In addition, the bill requires the judicial branch to 6 26 submit budget information currently submitted to the 6 27 legislative fiscal bureau to the department of management as 6 28 well. Currently, the governor has to include the judicial 6 29 branch budget request in the governor's proposed budget 6 30 without change. 6 31 LSB 7180JA 78 6 32 ec/cf/24
